Hi Guys,
I have just had a letter from my credit card companey Halifax re my credit card charges saying it will take them 28days to look into my complaint !! I have already sent my first letter saying I would give them 14 days what shall I do ?
If you are taking them to court over the matter then follow through but if not then you have to wait 8 weeks or a final response letter before you can go to the FOS(Ombudsman).0 -

Well its 2010 now, you can claim back 6 years easily, so 2004 is pretty perfectLegalBeagles0

Grettings all,
Having received a list of all my Lloyds TSB credit card charges (£516 @ £12 a time), I sent them the first letter on 1st March 2010. I wrote that I would be happy to forgo interest payments if they offered no resistance (I was close to using the phrase 'goodwill gesture'!). I added the following bits from the second letter in the vain hope that it would stop them fobbing me off:
I would like to bring your attention to the following points before you prepare your response:
1. I am well aware that these charges are detailed in my Terms and Conditions – this does not make them lawful.
2. My complaint has nothing to do with the November 2009 Supreme Court ruling regarding the Bank Charges test case.
3. You have no right to suspend my complaint.
4. I will not settle for any part payment.
5. If you respond by telling me that I do not have a case or you are satisfied with the way you have acted, then I will immediately commence court proceedings to reclaim my money, together with interest up to the date of judgment and any court fees.
I then added that if they paid the money immediately, I would pay the rest of the balance off and they would never hear from me again (which I thought would be a tempting prospect for them).
Twelve days later (12th March 2010) they replied saying that, because the charges were £12, they would not refund me the money. They claim that the OFT deems £12 to be fair and reasonable! They know as well as I do that the OFT didn't say anything of the sort!
Anyway, I'm taking them to court and wanted to clear up two things. Firstly, if they defend, am I entitled to see any evidence they will use (e.g. their calculations of what it costs them) beforehand? And secondly, I just wanted to make 100% sure that it all comes down to this; by law they can only charge me what it costs them directly.
Any help would be greatly appreciated.

They won't defend and they will offer settlement but be prepared to go all the way to court though.
Legally no bank has defended credit card claims with any specific success. The OFT specifically stated that only a court can decide what a fair charge is.0 -
I have just started my claim at moneyclaim.gov.uk. I've just realised, though, that I wrote the wrong address for Lloyds TSB - I used the Birmingham address that I needed to get a list of charges, instead of the registered office at Gresham Street, London. Does this matter?0

If I try to claim my charges back are they likely to want to close my accounts? I have an overdraft and don't know if the repaid charges, if they pay me any, will cover the amount owed on the overdraft, bit worried about doing it as I wouldn't have enough money to settle the overdraft if they close the account and demand immediate payment. Could they do that?

My Barclaycard reclaiming has not been as good as others I have read about. I wrote letter no.1 asking for Data info. and enclosing £10 in August 2009..this took until very end of December to come after various phone calls and letters. I asked for the charges to be repaid and included contractual interest via Letter no.2 , I had one letter 14 days later saying they were looking into it and have just received another saying they still haven't resolved the matter and will reply by April 17th...! Is it right that I need to give them 8 weeks according to the OFT to investigate my complaint before I send letter no.3 threatening court action ? even though my letter said 14 days to reply on it?
I might get it sorted in a year ! My husbands took 2 months with 2 letters:rotfl::rotfl:0
