I have just written out a letter to ask for a list of charges for my credit card and bank account to Lloyds, was just about to post it. I have put the Birmingham address as listed on this site. Is this the wrong address?
If I try to claim my charges back are they likely to want to close my accounts? I have an overdraft and don't know if the repaid charges, if they pay me any, will cover the amount owed on the overdraft, bit worried about doing it as I wouldn't have enough money to settle the overdraft if they close the account and demand immediate payment. Could they do that?
TIA
Regarding your first point, you have used the correct address - the Birmingham address is for asking for a list of charges. I also used that address for sending Letter 1 - it was forwarded to the right department and I received a reply. I just thought that in this case, when they received the claim letter, they might not forward it - I didn't want to win by default and then have them tell me they had no idea about the claim's existence.
Anyway, I spoke to the Moneyclaim helpline and was told that they couldn't advise me as they are not legally trained. He did say, though, that he would probably wait, as he felt it was unlikely they would ignore it. He also sent me a form (electronic) to change the address and re-serve the claim. I can do this at any point - it's free and all I'll lose is a bit of time (worst-case scenario).
Regarding your second point, I think they can, although I have no idea what kind of timescale they can enforce; that would probably depend on your circumstances. I was worried about this, so I just delayed my claim until I was in a position to pay off the rest of the balance. Someone else would probably be able to advise on thsi better.

Can I clarify that you have sent a letter to Lloyds to reclaim credit card charges, that they have failed to respond and you have filed a claim? If you file a claim then you need to use their registered address in London to file the claim or, if you win by default, they will look to overturn it/

Credit card charges are separate(for Dollardog) and they can only pay onto the credit card or direct to you depending on if you sue them or they offer a settlement prior to you needing to claim in court for charges.0 -

I sent the letter and they they did respond, saying that they would not refund the charges as they believe they are fair and reasonable. I said in the letter that if they did this I would immediately commence court proceedings.
I have filed a claim - it was issued on 16th March and served on 21st March. I will now fill out the form to have it re-served at their registered address (Gresham Street, London). Thanks for the advice.0 -
Thanks to Rick01 and natweststaffmember. I will get my letter posted tomorrow to find out how much I could try to claim on my charges.
I was just worried that they might try to close my accounts, as if the charges I could claim might not cover what I owe them. I don't want them getting back by saying I need to pay all of my debt at once, as I couldn't do that.
Mind you, the way they are piling chages on top of charges, I would think they owe me quite a bit.0 -
I have been following the guide on the site, and am now pursuing the Human Argument, (i.e. I was suffering financial hardship).
However, I have had a reply from HBOS and they are asking me to complete a financial statement for the current time!
My circumstances have changed substantially since the period I complained about, (9 years ago), does this mean I can no longer claim my charges back because I have worked hard and managed to improve my financial position despite the banks efforts in 2001-2007?0 -

This is about credit card claims. Is this a credit card claim or bank account claim? If it is credit card claim then you have read the wrong guide. You need to read the guide to reclaiming CREDIT CARD charges and NOT bank charges.0 -

Hi, this is a claim for Bank Charges, I first submitted my claim in 2006, the complaint was suspended pendign the Supreme Court hearing, I have since restarted my pursuit.

I have just received a list of charges from the Co-op and have today sent out the letter claiming these back.
Charges total £386 plus interest £108.21 total claim £494.21.
Has anyone had a success with the Co-op?0 -

If you read the MSE Guide then you should be able to continue on as you see fit but read it very carefully on the bank charges claims, ok?0
