    So in your experience do the oft write to them and tell them to pay me back then?
  • The FOS will as they are the ones who will adjudicate. The reference to the OFT is that they had a report in 2006 that specifically stated that whilst they set the level of charges at £12.00 that only a court could decide on a fair charge.

    I wrote a few week ago about reclaiming charges on my Mum's Ambrose Wilson. It was £676.00 and they cleared the balance of £360.00 in settlement. I wrote back asking for the rest and they have written and offered £316.00 but she has to sign to say it is full and final. However I am also claiming PPI from them and dont want to let her sign something that says f&f incase it jeopardises the other claim. Any ideas anyone?

  • Hi all I'm a new member and need a bit of help. I would like to claim charges on Capital One and Barclaycard. There is no way I can pay off my outstanding balance, so if they agree to pay, will they just pay it towards the outstanding balance. Are they then likely to cancel my cards and expect the balance to be repaid in full, or will it carry on as before, but unable to use cards. Any help would be appreciated.
  • Hi there. I have a query regarding creating a claim for getting back my historic credit card charges.

    In essence I'm in a bit of a predicament. I used to have an old Lloyds graduate acccount which for various reasons I became overdrawn with, and I eventually settled in full and closed the account. During that time I also submitted an online claim to reclaim my bank charges with Lloyds, which I duly won.

    When I settled the account they agreed to settle for £2000, which was basically £500 less then they could have reaqsonably asked for...

    So in essence my concern is that having claimed for bank charges once already, I am chancing it creating an additional claim...

    Your thoughts on this would be very much appreciated.

    I have done the same with both those companies and they will just pay it off the balance. There is no reason that they would demand repayment. You could also think about reading the threads on here about getting the Consumer Credit Agreement from them to see if they can legally chase you for the money. So far I have got 3 credit card companies to stop chasing me as they either could not produce and agreement or it was invalid. Good Luck

    Are you reclaiming since the last payout and was there additional charges?
