Credit Card Reclaiming Discussion

Just a question. I have currently made a CCA request to AA Visa which they have been unable to fulfil. I also have a claim in with them to reclaim credit card charges. The charges are all £12 ones, but I'm still reclaiming as I've read success stories along these lines.
My question is, if they pay up will they automatically deduct this from the balance outstanding on the credit card. The account is in dispute and payments are currently being withheld in line with the guidelines - just wondering whether this affects how they will pay the claim if successful? hi can someone give me abit of advise pls, i am claiming on a few credit cards but one im abit worried about is - Associates gold card i have not seen anyone who has had this card, they changed their name to citfinancial , so should i write to citicards.
Also sent a letter to Bank of Scotland requesting list of charges on 8th July 2009 not heard anything from them where should i go with that because it is well over the 40days, didnt send a cheque as previous posts say that they dont charge for that even if they did they should have written telling me this like cap1 and barclaycard did . Any advise welcome
1. Yes write to Citicards.
2. Did you send your letter by recorded delivery or got proof of posting ? If not then I would send again recorded delivery. Oh and send a cheque for the £10 as well. That way you adhered to all the necessary points required and if you do not get a response by the 40 days then report to the Information Commissioner.
Good luck,If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -
I have requested a list of my charges for the last six years from Barclaycard and have just recieved an email saying,
"Unfortunately, we are not able to provide you with this information. It is not appropriate for companies to retain data about an individual for longer than is deemed necessary, therefore any such data that we held on you was securely destroyed in line with data protection guidelines
We are able to provide you with more recent statements, however should you require them.
I hope this information will help you."
What is my next plan of action?
Well thats strange, they managed to supply me and the wife with copies of the 6 years worth of statements.
Think that is a fob off. I would write again, stress that they are required to supply this information by law and that shouldthey not be forthcoming you will Information Commissioner their ar*e !!!If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -
Hi
I have recently, out of frustration accepted an offer from a PPI reclaiming company because I was getting no reply from Barclaycard about PPI insurance being mis-sold.
The thing is, I have followed your instructions and after 2 days of receiving a letter from the reclaiming company I received a settlement letter from Barclaycard reffering to MY letter that I sent them in July. I am going to accept the offer as I am in the red and currently on a Debt Management Program.
My question is this, the 14 day period has passed to cancel and in their "contract" it states that if I cancel I have to pay them £500 or pay 25% plus VAT for any payouts.
I have 2 more claims that they are handling, one that got nowhere with Santander and a Barclays Loan claim.
I only received the letter from the claiming company 2 days ago saying that they have sent in the paperwork for my claims and that I should NOT accept any claims but refer any offers to them. I feel with this claim though that the final settlement response was because of the groundwork I did because the banks offer letter refers to my final letter (before complaining to the FOS).
I am going to accept anyway because of the reasons above. How legally binding are these contracts with claiming companies.
Also in their letter it states: "We have now submitted a detailed report to Barclaycard and will contact you as soon as we hear from them. Please note that PPI claims are taking three to four months to complete on average." So I doubt that they can claim that they were responsible for the claim being succesfull after only 7 days.
Please can anybody give me advise on where I stand and where I stand legally if they want to claim their 25% for this claim.
I know..... I should have been more patient, but I am in a financial mess and got no reply from the bank. Please help.
Kind Regards,
Papapax
You say in your details that the cancellation period is just beyond the 14 day period. How far beyond ? Wasnt your cancellation letter in the post to them and it must/might be delayed due to postal strikes ?
Only a thought. If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -
i have a credit card with halifax. i went with a company back in june 2009 and i have only just got a reply back from them saying they have managed to get £392.98 back in charges for me. that would have been nice if i had actually received that money instead it has gone on my credit card to bring the balance down on it , therefore i have got to pay that company £88.80 for there fees. is it right that you should get the money yourself or should it go on your cards.0

I sent a letter to TSB Trustcard asking them to repay charges levied on my now closed credit card account, on 22nd Septemeber. I used the template from this site.
In the letter I asked them to respond in 14 days. Those 14 days were up on Tuesday 6th October. I haven't heard anything back from them.
I stupidly didn't send the letter by recorded delivery. However, given that there are postal strikes around at the moment, how much longer do you think I should allow them before sending another letter? And when I do send another, should it be the same letter I just sent (giving them the benefit of the doubt, and assuming they've not received it) or should I send the next letter in the queue.0 -

Hi everyone,
I'm new to this and have just received back statements with charges and am about to do the second template letter, but wasn't sure where to send it....should it be to the credit card company address that issued the statements or should it be the same address for the first template letter, sorry I'm sure this has been asked before, but I just want to send them of to the right place. Any help would be appreciated0 -

Unfortunately, nothing you can do Im afraid. Yes the money awarded goes to any outstanding debt first. Even if you had done this complaint yourself, they still would have credited the amount to the card.
Word though. £88.80 for a companies fees !!!! That is extortionate. The very same process couldve been done by yourself for £10. It is very easy, just follow the stop by step procedures on the RECLAIM tab at the top of the page.If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -
Can i ask for charges back for two different account with Halifax.
I have a Halifax Visa card im waiting for statements and also have a HBOS Mastercard.
I asked for charges back before on the HBOS but never persued it after the fob off letter. This time im going to court if they say no but can i include both accounts on my initial 'asking for refund' letter and give them a break down of both account charges with a total amount.
Ie.. £500 from account number 1 and £200 from account number 2, therfore i request a total of £700.
Thanks in advance!0
