Hi, new to posting on forum so hope I've done it right!

I've successfully reclaimed from RBS & Barclaycard but Lloyds TSB are taking ages to send copy statements but the worst one is Capital One!
Capital One have been rude over the phone and have refused to pay, when I sent court letter they still refuse saying their fees are fair and it would be wasting courts precious time if I pursue but say I can report to Ombudsman, I am still in the right to continue claiming through Ombudsman?
The wording of their letter is very clever, can anybody help me please?
Claim every single charge back from Capital One and use the Ombudsman or the County Court.

Is that the difference between their old charge and the £12.00?

  • Hello

I don't know if anyone can help. I am tring to get my credit card charges back from Debenhams, now Santander and had originally sent off for my charges and got a reply saying we couldn't find it for certain periods they have said they only charged £18 for Late Payment Fee's although I swear they were more and also I thought I went over my limit. Is there anyway of finding this out. I also have recieved the usual we will refund you the difference between the charges and current £12.

    They have said

"This is our final response. As the last charge was applied to the account on 20 July 2006, the Financial Ombudsman Service has no jurisdiction on this matter." Is this correct. Also they are saying we will not pay interest as I agreed that they will charge interest on any outstanding balance so I think they are getting a bit confused on this bit.

Do I hit them with a court action letter?
    Thanks
  • Hi

I'm in the process of trying to reclaim from BoS, total trying to claim is around £200 and they have sent me a letter offering £39. Not to sound greedy but i think i'd like to push on with claiming the £200. Which letter would I use to respond with?

    Thanks :)

Hi there. What do I do now as they have sent the cheque back? Do i send another letter requesting the detailed statments again and send another cheque or do I send another letter? Sorry if my questions are all the place, still trying to get used to the site. Thanks

Did they say anything in their return letter ? Ultimately did you send your letter recorded delivery ? If not, I would resubmit again but send recorded delivery?

Post up again if you get a problem.

Yep carry on . Just modify the last letter accordingly. Thank them for their payment which you accept without prejudice but you were actually claiming (full amount) and give them x amount of days to pay up or court action will follow.

    Good luck.

  • Hi folks
Can anyone help me with the following:
I have been contacted by a company based in Glasgow who specialise in clearing your cc balance as it stands £---? plus say that they can reclaim monies on your behalf. The details are related to the consumer credit act 1974?? I think it is. they state that if the cc company has increased your credit limit without your authorising it they are in breach of the consumer credit act? is this correct?
In addition they have advised for an initial fee of £375 they will begin the process which at the moment takes approx 8-12 wks. They have advised that when/if given permissin to persue the cc company and payment of the above sum, They can then charge the cc company all the hours they accrue. There would also be a final payment of £275. But all monies claimed back over the period of time you have had the card will belong to you the customer and in addition your card balance will be cleared.

Has anyone in the forum had any experience of this and were you successful?

Looking forwrd to anyones experience or guidance in this matter
