I have requested a list of my charges for the last six years from Barclaycard and have just recieved an email saying,

"Unfortunately, we are not able to provide you with this information. It is not appropriate for companies to retain data about an individual for longer than is deemed necessary, therefore any such data that we held on you was securely destroyed in line with data protection guidelines
We are able to provide you with more recent statements, however should you require them.
I hope this information will help you."

What is my next plan of action?

Finally received a letter from Capital 1 offering me £60, I had orginally asked for £153. When I read it at first I thought no way but as the day is going on I am unsure if I should just accept it.

If I take it further would I have to wait another 6 weeks before I can contact the FOS (I originally wrote to Capital 1 2weeks ago asking for my money back)? Sorry got a bit confused about this bit :o.

    Thanks in advance.

  • Hi peeps I recently reported my success in claiming back £500plus from Barclaycard. I have just recieved an offer from Marbles ( now being handled by Hbos) they have offered £100 but my original calculation was £400 plus, I am wondering what to do should I accept or go for the rest I cannot find any success stories from Marbles (might be looking in wrong place). Any advice will be appreciated. Thanks

  • Hi

I have recently, out of frustration accepted an offer from a PPI reclaiming company because I was getting no reply from Barclaycard about PPI insurance being mis-sold.

The thing is, I have followed your instructions and after 2 days of receiving a letter from the reclaiming company I received a settlement letter from Barclaycard reffering to MY letter that I sent them in July. I am going to accept the offer as I am in the red and currently on a Debt Management Program.

My question is this, the 14 day period has passed to cancel and in their "contract" it states that if I cancel I have to pay them £500 or pay 25% plus VAT for any payouts.

I have 2 more claims that they are handling, one that got nowhere with Santander and a Barclays Loan claim.

I only received the letter from the claiming company 2 days ago saying that they have sent in the paperwork for my claims and that I should NOT accept any claims but refer any offers to them. I feel with this claim though that the final settlement response was because of the groundwork I did because the banks offer letter refers to my final letter (before complaining to the FOS).

I am going to accept anyway because of the reasons above. How legally binding are these contracts with claiming companies.

Also in their letter it states: "We have now submitted a detailed report to Barclaycard and will contact you as soon as we hear from them. Please note that PPI claims are taking three to four months to complete on average." So I doubt that they can claim that they were responsible for the claim being succesfull after only 7 days.

Please can anybody give me advise on where I stand and where I stand legally if they want to claim their 25% for this claim.

I know..... I should have been more patient, but I am in a financial mess and got no reply from the bank. Please help.

    Kind Regards,
    Papapax

I would decline it and tell them that you want the lot.
