I am on the process of reclaiming default charges from MBNA amounting £294.15. On July 30 I recieved a letter from them stating that all their charges are fair and on the agreement but offering me £104 as a matter of goodwill. I wanted the whole amount so I sent the 2nd letter threatening to go to court but put without prejudice will accept £250 on July 28 (did not put on account the £104 that they will be sending). I recieved another letter from them with a cheque £104 enclosed they did not say that it will be their final settlement. So I presume that they would just send the remainder of my offer which is £146 but its been 15 days and I still haven't heared anything from them. What should I do now? I still have the cheque and haven't cashed it yet just to be in the safe side.

I hope you can shed some light on this part. Very confusing.

    Thanks

Send another letter to them RD acknowledging receipt of their cheque which you gratefully accept as a part payment and without prejudice and that you are still seeking the difference amount ie £146. 14 days to comply or court/FOS.

Makes no difference if you bank the cheque or not though, as they cannot enforce the act of banking a cheque as a acceptence settlement (personally I would bank it asap, as I would rather it earn interest in my account than still in their coffers. )

    good luck.
If you see a penny, pick it up, all day long you'll have good luck !!!!!! :D

Ok the link was to the guide to reclaiming so click on "reclaim 1000's", 3 along from Martin's face(at the top of this page). On the page it gives the numbers of templates downloaded. The 4th one down is credit card reclaiming. click that and it will take you to the guide and follow the steps which has links to the templates.
