Does this mean that I have to wait 8weeks before I can go to FOS even if I had sent the 3rd letter wanting my money back?0 -
Hi Folks
Regular viewer on here but a first time poster.
Can anyone help answer my 2 questions please?
1. Can you reclaim on store cards in the same way as credit cards?
2. I have reclaimed on all of my old credit cards but I once had a Mint card but I don't have a record of the account number anymore, any suggestions of how I could get hold of it? I called them but they said they have no record anymore.
Many thanks in advance.0 -

Hi Everyone,
I submitted an SAR to Goldfish and today, over two months and three letters later, I received a reply from Barclaycard (who now operate Goldfish). They cannot find the statements or any other account information between June 2007 and the date the account was sent to a DCA (1st Credit - don't you just love them?) in August 2008 - a total of 14 months.
Anyone any idea where I now stand? The total of (alleged) debt that was passed to 1st Credit was £10k. Is the debt enforceable?
I have obviously sent a letter back to Barclaycard asking them to confirm thay have no records and an email to 1st Credit ensuring they have none. Strangely I had another Goldfish account (formerly Morgan Stanley) and statements were present up until the time it was passed to a DCA (Cabot) in September 2008.
Any advice gratefully received!0 -
I am really confused of what to do next....I have posted here twice about this particular problem but seem no one knows what to do either.0

I'll stop wasting time, if I were you, and file a complaint against them with the Info Commissioners Office:

Did you send the £10 DPA fee by cheque/postal order?
Did you post your letters via recorded delivery? A must.
Also, tell the DCA that your a/c is in legal dispute, so you will not be paying anything. I told a dca exactly this, almost 2 years ago after HSBC passed on my o/s CC debt.0 -
At which part are you at?
I am on the process of reclaiming default charges from MBNA amounting £294.15. On July 30 I recieved a letter from them stating that all their charges are fair and on the agreement but offering me £104 as a matter of goodwill. I wanted the whole amount so I sent the 2nd letter threatening to go to court but put without prejudice will accept £250 on July 28 (did not put on account the £104 that they will be sending). I recieved another letter from them with a cheque £104 enclosed they did not say that it will be their final settlement. So I presume that they would just send the remainder of my offer which is £146 but its been 15 days and I still haven't heared anything from them. What should I do now? I still have the cheque and haven't cashed it yet just to be in the safe side.
I hope you can shed some light on this part. Very confusing.
