  • Hi Everyone

I have been scrolling the internet trying to get advice on reclaiming both bank and credit card charges. I have got into a terrible pickle and am daily trying to decide whether bankrupcy is a better option but for now I'm still fighting.

I run my own business which has been struggling over the last year. Stupidly, I was bailing it out with my own personal credit and am now in huge debt. As you would expect I have probably spent thousands on charges etc.

The problem is that my business account has an o/d which can be withdrawn if I enter into an arrangement with my creditors so I have been trying to keep that bank out of any arrangements or reclaims up till now. I have made an offer to pay all other ccs and loans to me personally of a small amount for now. This is with the exception of anything related to RBS, so they don't twig whats happening and withdraw the o/d thus bankrupting the company.

I have probably a thousand or more to reclaim on my personal RBS account alone as well as cards like Mint, also run by RBS, but I am too scared to claim becuase of the business account. Has anyone been in this situation with personal and business accounts. The business is, I feel, on the mend and could pull through but it is very very precarious at the moment so could really go either way.
I really would appreciate some advice as I am at the end of my tether

So should i go straight to court or threaten? Anyone else had this with EGG?

I'm in the middle of this process too. Had exactly the same letter from Egg, saying about the OFT agreeing their charges. I have decided to give the Ombudsman a try anyway and rang them to get a reference number before filling out their complaint form and sending it off, along with all the relevant letters etc.

That was 1 week ago, should I expect the Ombudsman to side with Egg because of this dispensation? If they do I fully intend to go to court over this - no way every time I go automatically 1p over my limit it costs Egg £16 BS tbh!!

Will keep u updated with my struggle.

Successfully reclaimed £280.00 from RBS :rotfl:
STILL waiting to receive statements from CAP 1!!
BIG THANKS to all @ this site - I would never have reclaimed anything if not for the help and advice on here!
  • Hi Everone,

I sent a SAR off to Goldfish on 16th June (1st class) for two accounts (one formerley Morgan Stanley. I received no reply. I sent a reminder on 27th July - to date still nothing. Has anyone else had this sort of delay with Goldfish? Most other companies appear to have reasonable turn around times and often return the £10 fee.

    Any info would be appreciated.

Google OFT 842 and quote them 1.14 which states only a court can decide a fair charge.
