  • Please help if you can!

    I owe Barclaycard £3,600. They closed the account and I'm negotiating repayments with them. I am going to reclaim their charges. Will they refund me the money directly or will they be allowed to repay part of the debt I owe them with the refund? (Which would be against my wishes).

    James, sorry pal. I believe any refund awarded will be offset against the outstanding debt. If there is any left after debt paid then balance could be paid to you. If Im wrong, I sure somebody will post after me and correct me.

    Furthermore, you could argue financial hardship as to a reason to receive the money directly but I dont fancy your charges.

    yes- i succesfully reclaimed 1300 from barclaycard and they paid off my balance which i was more than happy about!

    I have received an offer from capital one to repay 400- i owe them 800 and my initial claim was for 1600. i know they won't agree and i'll have to go through the motions of court or fos but i'm planning on sending them a rejection letter today!

    Help please. I received my second letter from Capital 1 today which they have said is their final offer as they are confident that their default sums are fair and legal. I would like to pursue this as it is for £300 and they have offered less than half. My question is how exactly do I go about this now..... Thanks in advance.

    If I was them, I would say they are fair and legal. Might be worth giving them one last chance and make them aware that if they do not pay up that you will take them to court and allow a court to decide a fair charge.

    I really need someone's help.

    I applied to reclaim the PPI charges on my HSBC credit card in April 09. I took the card in 2003. I couldn't find the paperwork and I know it was probably foolish not to ask for the info but decided to chance it anyway under "not given correct info" as I don't recall ever being told anything about it.

    I received a letter a few weeks ago to say that they are rejecting the claim as when I took the card out they gave me literature and also told me about how the 'repayment protector' worked; and that I was told I had 30 days to cancel should I wish to.

    However, it turns out that I took the card out at the time my father was very ill (Aug 03), and within a few weeks of taking the card out he died (early Sept 03) - not only leaving us devastated, but I had to make all the funeral arrangements, so cancelling the PPI was the last thing on my mind. HSBC could have told me that grass was blue and sky green and I would have believed them!!!

    I haven't been in touch with HSBC again since receiving this letter, but don't know what to do next.
    Do I contact HSBC again telling them this an try to appeal to any possible better nature they might have or just go to the FOS? Or do I just forget the whole thing?

    The claim is for £570 - a lot of money to me right now.

    Can someone please help me???? :confused:

    I would request a Subject Access Request (SAR), they have 40 days to comply and send all the information as requested on the SAR, there is a charge of £10 cheque payment of postal order payment required for this and post by recorded delivery.

    You received a standard response, and you are able to cancel when you like.

    So sorry about your dad and it is understandable, but you are able to cancel when ever possible anyway.;)

    I would write back and tell them you want this reconsidered, if they did mention the FOS, then maybe go this direction, you can download a complaint form from the FOS site and print off, or ring them, ask if they can help and take it from there, they may do this over the phone for you, or arrange to send you a complaint form, maybe give the FOS a ring first and see what they have to say in your case.

    Hi there!

    Its been a whil sincei have been on here. I had success in claiming back £3k from shabbey, back in June 07, and also Capital One. I also helped my boyfriend claim back his charges from Lloyds TSB a few months later so i have been a dab hand at this reclaiming lark.

    However, i made the mistake of not keeping up to date with things with the test case etc, and have a new account with Natwest and need to claim back some charges that unfortunately i accumulated during being out of work last year. It only comes to around £200.
    so i'm intending on claiming this back with the hardship route as i recently did an income and expenditure form with my mortgage provider, so i'm hoping to back up the whole hardship thing with that if i can get a copy!

    However, my questions is, when it comes to Captial One credit card, i have already claimed with them and i accepted the money they gave me back and they have been charging me £12.00 ever since. again, there is a good £200 to claim back. Can i make a new claim even though i have claimed off them before?

    I know this was a bit long winded but thanks in advance! I now have a lot of reading and catching up to do!!
  • Yes you can on the credit card claim.

    Google OFT842 and read 1.14 on that.
