    :confused:Hi I am trying to get my charges back from Capital one £789 they offered 179 + 10 interest I declined their offer as this was their final response I went ahead with MYCOL which was deemed to be served onthe 23/05 then on the 27 /05/09 they filed an aknowledgement of service can anyone give me any clue as to what happens next as im not sure what this means is it bad news. any advice greatly recieved. thanks

    They also state: "This led to large numbers of people being advised to ask their credit card providers for information, held as part of their old credit card statements, to find out how many times they have been charged more than £12 so that they can reclaim the difference"
    The OFT themselves stated that £12 was merely the level that they would not take regulatory action and that they wouldn't expect the bank to lower their fees to the threshold level. Remember, if you want the difference between the previous charge and £12 then fine take that line, however, since you need the info for court action I wouldn't personally do that myself but it is your claim.

    Just means they have 28 days from the date of service of the complaint to enter a defence rather than 14.

    I guess its just another delaying tactic , stick with it and good luck.

    I've claimed FULL charges back from MBNA, Halifax and NatWest and they all offered amounts which I refused and sent the above letter. It certainly did the trick! I've reclaimed around £1,000 so far :T

    To anyone that have claimed from NatWest,
    They sent the list of default charges total to £140 I am trying to claim the full amount with interest. I have a question to the calculator, do you have to put the right date of the month it was charged? Because on the list they've sent me they only put the month and year of the charges, so do I just pick any date of the month it was charged?

    If you haven't been given the dates then start at 1st of the month cos the bank gave you the data without that date.

    Just recieved the information from the courts regarding the MCOL that i issued against CAPITAL ONE it was aknowledged on the 27 may the reason being that they are defending the whole of the claim has anyone else been through this do they take it all the way to court. Any advise would be grately recieved. thanks
