    Or you might want to customer make a letter incorporating what the OFT actually wrote(report is OFT 842--google it and you can read it yourself in full):
    Under clause 1.14

    "1.14 It must be stressed that this is a statement of our position and reflects the exercise of our discretion as an enforcement agency. Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims"

    I have highlighted the important bit albeit the sentence afterwards is as important I guess.

    Just dug out the letter they sent me. It does say full and final settlement, though still states a gesture of goodwill and without admission of liability. Is there definatly nothing else that could be done?

    Its FULL AND FINAL settlement of the claim. by all means write to them but be aware that they may bring this up.

    Hi,
    I'm a little confused, would be grateful if anyone could help me out.

    I've followed the guidance for reclaiming credit card charges to the letter, took my complaint to GE Capital for around £400 then later went to FOS when GE refused to pay.

    Just heard back from FOS that they have no authority to deal with complaints prior to 6 April 2007. Has something in their remit changed? My charges run from May 2003 to April 2006. I've claimed credit card charges back from Egg and MBNA through the FOS in the past few months and they were for charges before April 2007.

    I've tried contacting FOS to speak about this but can't get through. Any help would be great!

    Do all credit cards charge PPI?
    If so is it always seperately itemised,or hidden in the monthly payment?

    Hi everyone. Today i had a partial offer from mbna of 102 pounds, sadly i originally requested nearly 300. Im not happy with the 102 and wish to push for the full amount.
    Can anyone show me a template letter of what to do next as there does not seem to be one in martins guide?

    I would write back and state and thank them for their kind offer, but to save on court cost to them you will only accept £300 or you will be forced to take it to court and will make them aware of the fact that you have tried to resolve this amicably prior to suing.
    Give them 14 days then SUE THEM.

    In true Moneysaving fashion, I wanted to know if it was entirely necessary to make the SAR before claiming. I didn't make one on a successful bank charges reclaim a couple of years ago and I thought I might get away with it here - not least because I had 6 credit cards at one point and don't much fancy paying £60 for the privilege!

    Anyway, joking aside and to cut a long story short, I found this page on the ICO website, meaningful paragraph is:

    "Contrary to popular belief it is not necessary to request the information held on old credit card statements in order to reclaim any unfair penalty charges. The latest advice from the Financial Ombudsman Service (FOS) is that consumers wishing to dispute their penalty charges need only provide the financial institution with details of the credit card account and the dates bewteen which the charges were incurred. "

    This information is on the ICO website but I am not allowed to post links. A simple google of the above wording should yield the correct page though.

    Can anyone shed any light on this please? In all seriousness I will happily make my SAR if needs be :)
