I would not call them, stick to the time scales

  • Hi,

I put in a claim to Natwest to reclaim £182 worth of charges, to which they ultimately responded that they would stump up £54 (i.e. the difference bet £12 and whatever they'd charged me). However, their final response was back in November 2007, and I was going to go to the Financial Ombudsman, but various circumstances meant that reclaiming etc took a back seat for a while.

My question is, is it too late now to do anything about this, as the letter dated 13th Nov 2007 states that I will need to go to the FOS no later than 6 months from the date of the letter? I have tried writing to Natwest again, but they just send me a copy of this letter as representation of their final response...

    any ideas?

    Thanks!

Do not accept their offer, just fire off a second letter thanking them for GOGW but tell them you want the full amount with interest and if they havent sorted it in 14 days you'll "County Court" 'em.

i know it sounds daunting and you're only little you against a multi million pound bank but it works. i've had two successes both made low initial offers and then stumped up full amount and interest after second letter.

i've also got three others who made initial offers and i've writen back with the thanks but no thanks letter.

looking forward to your first post on CC reclaim successes thread.

you definitely do. And expect them to state that the OFT said it was fair because they didn't say that. Read OFT842

Yes write to them one more time and state that OFT 842 stated in paragraph 1.14 that :
"1.14 It must be stressed that this is a statement of our position and reflects the exercise of our discretion as an enforcement agency. Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims."

Tell them that you are giving them one last chance to avoid legal costs by paying out x amount(the amount of your claim). Give them 14 days to respond and tell them that any response they make will be made available to the judge in county court as you have given them ample time to resolve this matter. See what they say ;)

Send the second letter and I would add an additional paragraph in that to include the words, I am giving you a final attempt to resolve this matter prior to taking legal action, In the Office of Fair Trading Report of April 2006(OFT842) it states and quote paragraph 1.14(it is on a post above in full). Only a court can decide a fair charge so to avoid further addtional court expenses please send me an offer for £x within 14 days or I will go to court and make the court aware of the contents of this letter.(something like that :D)

    Hi,
I remember sending RBS an intial request for details of charges applied across 6 years about 1 year ago and was put off by their reply where they sent me a copy of my online application showing I'd ticked the box where it says insurance.

It all totalled about £1000 I remember, should I still pursue or have I no chance because of that tick in the box on the online form?
