    I sent a SAR to natwest second class stamp attached, and they still sent the data out so recorded delivery not always necessary.
    I have not worked for NatWest Bank since February 2009

    Went after ge money charges and have as a full and final been offered difference between £12 and £18 they have told me if i'm not happy I should go to the ombudsmen is it worth doing this or will the offer not change .:confused:

    They've said exactly the same thing to me and I am taking it to the FOS.

    Like they say - you don't ask, you don't get - and you just need to look at the success stories to see that people are usually successful in claims when forwarding on to the FOS.

    UPDATE:

    I just called the FOS, and I can only reclaim charges through them that were made after 6th April 2007. So it looks like it will have to be court action...

    alot of my charges were after this date so you reckon its worth pursuing :D

    It's totally up to you, you can just go through the FOS, or you can raise a claim online as per martin's instructions.

    What you think you're going to do?

    I'm in 2 minds because the majority of my charges were after 6th April 2007.

    I think that may be when they became regulator for them which is why they are saying that.

    EDIT: I think you might want to send them another letter and make them aware that to try and avoid further legal costs to them from a court claim you will settle for x amount with interest. Remind them that OFT842 which was April 2006

    "1.14 It must be stressed that this is a statement of our position and reflects the exercise of our discretion as an enforcement agency. Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims."

    Give them one last chance say 14 days from the date of the letter.

    If they said full and final then they are trying it on. Write with the wording suggested or write it in the way you want to or even read OFT842(google search brings it up nicely).
    Remember, you are telling them that you are being reasonable in attempting to settle the case prior to them incurring further costs. You are the one doing a favour and not them. Does that make sense?
