    I have a personal loan with HFC for an electrical item and am in arrears. They sent me today the agreement I asked for and a statement. I owe £233.59 on an original loan of £318.55 but I now discover that the late payment fees are nearly £200.00. They phoned today and said they were sending me an offer of reduced full and final settlement. Question is can I recalim these charges??

    Yes it would seem a little strange just the ONE charge and it ended up with a debt collectors, as for the account to be passed to the collectors it would need to go through Tescos own default procedure ie you hadnt made a payment to them for a number of months and this wouldve incurred a few charges to say the least.

    In short definately have another look at the statements. What have you got to lose.

    Hi,
    I'm new to posting on the forum and hope someone can help.

    I have written to Tesco and LloydsTSB to claim back my dosh.
    Tesco have offered me £32.40 when i requested £259.08, so i'm in the process of sending second letter threatening court action.
    Lloyds initially sent a letter saying "sorry you've had cause to complain" (what?!?!?), but then another arrived: offer of £33.73 when £183.20 was requested. Second letter being typed right now!

    My main question here is that both have said that the amounts will be applied to the accounts. Can they do ONLY this or can i state that i want the cash?

    Yes you can claim the charges back, but you need to send a Subject access request to all of the providers first prior to reclaiming the charges.

    Have a look at reclaim cc charges.
    it's you asking cc company for a lsit of charges.

    I dont think anyone's pushed them, but i'm just grateful for the reduction in the debt. be thankful for small mercys.
    I am in the process of forcing barclays to give ME a refund rather than the debt collector they sold the debt to. I'll post when i get a reply.

    Go to reclaim cc charges on this site. Follow simple steps for subject access request, then reclaim your charges.

    My amibition is to see banks squerm like so many of us have.

    I think you need to send another letter back stating that they have not complied with the Data Protection Act 1998 and so if they haven't responded with the information by 40 days then you will complain to the Information Commissioners Office.


    I think you need to submit a complaint to the Information Commisioner.
    They have failed to comply with their duty under the data protection act and therefore have commited a criminal offence.
    The Inf Com forced Barclaycard to give me my subject acces info after they failed after the 40 day dead line.
    if they still cant find it I'd check what you've got and if you think the charges continued through the missing months just claim them as well, if they cant prove they didnt charge how can they defend themselves.
