I was wondering if anyone knew if we have had to get a debt company in to help us out of our financial mess would we still be able to claim the charges from the credit cards we passed over to them? we had 3 and this is why we are in the state we are now!

Cougar Rules - I've got a bank charges claim in with Lloyds TSB for over £500 under the hardship rule and they won't look at it until the test case has gone through. Try post 392 he's had some luck.

This is basically the same question that I have.

I have read martins article in the sticky thread
    • Charges from before June 2006. Credit card charges from before this date will usually have cost between £30 and £35. With these, you can ask for either the full amount of each charge to be refunded or the difference between the actual charge and the OFT recommended fee of £12; for example, a charge of £35 minus £12 would give a refund of £23.
    • Charges after June 2006. For any charges on or after June 2006, you were probably hit for £12 each time. As this is already set to the OFT recommended amount, you simply need to ask for the full £12 amount to be refunded.
But I am still a bit unsure If I am supposed to include the £12 charges or not.

I would appreciate any help :D

Sorry to quote myself but does anyone know please. I dont want to send my letter off and look right a complete div if I am asking for the £12 back and not supposed to lol

    thanks

Ask for the whole lot back. That's what I'm doing with MBNA and TSB. Both have offered the excess over £12 (TSB with interest), but I'm back for the rest with the court letter. TSB have written within the 14 days saying bear with us but nothing from MBNA...I've prepared the MCOL ready for their a$$e$.

    Go for it.

Yes ask for the £12's back as much as the £25's....they still have not proved their charges are proportional to the costs so as such legally the full amount is claimabel despite the OFT guidance in April 06....and they are repaying it.

They will try the no, no the OFT says its okay letter but just carry on.

    Hi,

Just wondered if anyone could help me as i'm now a bit stuck as to what to do.

I put in a request for a reclaim of £2500 from Cahoot. After a few weeks and a couple of chasers they called saying they would pay me £290. I buckled and agreed, however then regretted it and wrote off to the Ombudsman to complain (I have been totally honest with the FOS and wrote on the form that I had previously agreed to the £290 but had now had a change of heart).

I have received the standard acknowldgement letters from the FOS. Yesterday I received the cheque from Cahoot for £290.

Now what do I do? I am torn as to whether to bank it (letting the FOS know of course) or would I forfeit any further claim if I did this?

    I'd appreciate the advice,

    Thanks, Jilksy.
