  • i was wondering if anybody could help me!!!

After getting about 1000 letters and 5000 phone calls from lloyds tsb i finally set up a payment plan of £40 a month to pay back the money i owe them.

my credit card started off with a £2500 limit but because i fell behind on my payments i gave up in the end because the charges were killing me, anyway i now owe them £3900. so as you can see it will take me for ever to pay off.

my question is will the payment plan effect me claiming? should i carry on paying it? and can i claim back what i have already started paying off?

i would be grateful for any help thanks every 1

correct me if i am wrong with a data protection access request which is what you paid £10 for dont they have 40 days to reply

then you can report them to the information commission

dont know how to etc but sure someone will let you know how soon enough

    good luck

Wilfs0- that sounds about right- ICO only deal eith gettingthe info (statements etc), rather than claiming back any charges, have a look on the main MSE site ('reclaim £1000s's link button at top of this page!). choose apprpriate section for bank account, or credit cards, then use the tenplate letters provided. most addresses are also listed- otherwise, write to addrss on your statement.

ALWAYS keep copies, ALWAYS send by recorded/registered post!

    typical timeline-

write to card/bank, asking for statements. if not in a rush, do not enclose or mention the £10 fee (every little helps, right?). They should write back fairly soon, if more info or the payment is required..

If nothing received at 30days from INITIAL REQUEST, send a reminder (email may be better?), warning that the Info Commissioner is pending..

40days- still no info? see the ICO site, and do report form or letter- add a note if your fee cheque has been cashed!

when stats do arrive, mark each charge (late / overlimit fee , but not maybe annual fees or interest?) on the stats for reference, then enter each onto the easy calculator online, and 'add to list'.

when all entered, select all and save to a proper spreadsheet- tidy up as needed, add card number etc. Send with claim letter 1, and diary to follow up as per rest of the guidenotes.
Long time away from MSE, been dealing real life stuff..
Sometimes seen lurking on the compers forum :-)
  • dizzybee- go for it! the agency act on behalf of the card co, so should call off actions pending a claim.

  • Hi,

How do you claim if you haven't got the statements etc... any chance?
I'm not sure how much and where, but no I have been charged the odd few times over the years, does this also cover overdraft charges?
Is it worth banging out a few letters and see?Cheers John
  • Hi,

I am a regular stoozer and have been moving debts from 0% to 0% for many years. I have had an A&L credit card for a good few years, and was offered a 0% deal from them with a 2.5% fee or thereabouts, which I took up. Unfortunately, I missed a payment about 1 month into the 0% period, and not only was I charged a £12 late payment fee, but they have also started charging interest every month. This means that not only did I pay the transfer fee, but I have now also paid 3 months interest and a late payment fee so I have actually paid far more than if I had just paid interest on the full balance every month.
I have just checked the small print and it does say that the promotional rate ceases to apply if terms and conditions are broken - but this seems unfair and I don't think other banks do it. My payment was only a couple of days late.
Is there anything I can do?
  • Im about to start the process of claiming my charges on my credit cards.

What I really need to know before I start is....

Can I reclaim even though they are currently with the debt collection services?

I have to pay numerous debt collections installments of my balances not the actual credit card companies, but could i still go ahead with the reclaiming?

Also I have store cards and also credit cards as a CCJ, can these still be claimed back?

Finally, does the reclaiming mean only credit card and store cards or can it be loans from the bank too?

All of mine are with the debt collection agencies bar one.

    Many thanks

i claimed back my charges even though they were with a debt collection agency, i just wrote to the original people i had the debt with e.g. barclaycard......i got most of my money back off them, which meant i paid off the debt (£1000) and had £116 left to myself! :j

dorothy perkins and debenhams (i had a ccj with dorothy perkins) and they still payed me some money back....................not a lot but better than nothing!

so go for it.............what have you got to loose?

    hope this helps, good luck!

i had payment plans with all the people i have claimed off and it didn't make any difference, i still got some money back, and i'm still paying the agreed amount until my debt is cleared, so as long as you carry on paying what you've agreed then i don't think there's a problem.

however.....if you're struggling to pay back the agreed amount the best thing i would advise you to do is go to see citizen's advice, they were brilliant with me.........i now pay an affordable amount every month to all my creditors and they have stopped my creditors from charging anymore interest.

don't suffer alone there is help out there, it's just knowing where to find it and i found it in citizen's advice bureau and then i found martin! :money:

so good luck and i hope this helps ;)

Unfortunately, there's nothing you can do about the interest rate, as you say it's in their T&C's and I can almost guarantee all other card have a similar condition.
  • I have today rec'd two letters from NatWest with an "exceptional offer " in two amounts for two of my accounts. I have 60 days to accept or decline. Has anyone out there had the same letters? If so what is the best thing to do. Both accounts are overdrawn, and bank charges are excessive. The amounts offered today clears the o/d accounts but no refund of bank charges. Any help would be very grateful. Jilly
