  • Hi, I am a newbie to posting on the site so apologies if i've done something stupid!

    I wrote to HSBC on 5th Jan using Martin's template letters requesting a list of charges (enclosing £10 cheque). HSBC returned the cheque to me 'as a gesture of goodwill' and enclosed a comprehensive list of all charges (totaling £120) on 13 Jan.

    I wrote to them using the second template letter requesting the full amount plus interest (£151 in total) on 19 Jan, expecting a fight on my hands, but I came home tonight to a letter from HSBC Card Services (dated 21 Jan) offering me £192.89 - more than my original claim - to 'acknowledge that you are a valued customer of the bank'.

    I shall write tomorrow to accept. I do have one question though; the letter states that they will send the payment by cheque, however I have a Managed Loan with HSBC - I presumed that if they awarded anything they would apply it to the outstanding balance on the loan. Does anyone have any experience of HSBC in this situation.

    I have also written to Egg who have been a little slower off the mark to respond. Fingers crossed though!

    I just heard today from NatWest with an offer to settle my claim. They originally offered just £112 being the difference between charges made of £20 and the "OFT guidelines" (their words) of £12. I refused this offer but advised I would settle for £500 provided they did so within 14 days (I was claiming £502 charges + interest - £617). They offered £535 in full and final settlement and I'm just waiting for their letter to come through after which I get the money .... hurrah !!!

    So keep at it - and dont necessarily accept the first offer. And dont let them kid you £12 is acceptable. On a positive note NatWest didnt charge for providing the full list of charges going back 6 years.

    Hmmm - If you've made a proper 'Subject Access Request' for the statements (I'm guessing you have, as they've cashed the £10), they have 40 days to provide the information, or they're in breach of the Data Protection Act...

    I had the same issue with egg, and sent a recorded delivery letter stating that they were in breach of the DPA, and if I didn't hear from them within 7 days with the information requested, I'd refer the matter to the Information Commissioners Office for investigation...The paperwork arrived quickly after that, funnily enough...

    I'd take the same course of action, and follow it up if they don't respond, with a complaint to the ICO - http://www.ico.gov.uk/

    They have the power to commence legal action, so most companies to tend respond one way or another...:p
    Once you received the statements from Egg did they refund you in full? I'm having the same problem, they cleared my cheque 18th Dec and I still haven't got the info. I asked them if I was subject to this treatment as mine was one of the 161000 cards cancelled by them.

    I Sent Off The Cheque For 10 Pounds For My Statements And They Took It On The 2nd December 08 I Rang Them 2 Weeks Ago And Promised I Would Have The Statments By The 23rd January 09 Rang Them Today And They Said They Can't Look Into It Now. What Should I Do Its So Frustrating!! Thanks To You All For Help I Have Reclaimed Over £2000 Back Now!!

    Can I first say that I realise there’s many forums on here all pretty much saying a similar thing, so im sorry if this is mentioned somewhere else, feel free to move it to the correct spot, if needed.
    It’s basically a story about reclaiming credit card changes; I’ve been ok up to now but have got bit stuck at a certain point of it.
    I’m acting on behalf of my mom who had a credit card from JJB (financial services) for a fair few years, and got into trouble and is still paying it off. She let me take a look at it, and couldn’t believe how much she was paying a month 39.9% APR is crazy in itself (problem for another day maybe, but any info welcome, if its possible to get this down, although don’t think you can L) but the charges for going overdue and late are £20 every time from about 5 years ago, up until now, where there still charging her £20 even though I’ve found out they shouldn’t be really any more.
    First of all I sent this letter below to them asking for statements so I could see all the charges in last 6 years.

    This went quite well an they sent all her statement records after about 10 days.

    I then (with help from the charges calculator from this website) calculated all the charges an interest that I think is owed to her and put this in another letter, asking for this money back and that I expect to here a reply within 40 days, which can be read below.

    After another 10 days or so I got this letter back (below) saying we are dealing with your request and it’s been referred to another department, were looking into it and you will here from us soon.

    As much as it’s good to see they have recognised our case, I’ve not heard anything back from then and its past 40 days of waiting, my question basically is what I should do now? I here in most cases they should get back to us with an offer and we need to decide whether to except or dismiss it or they just say something about we don’t have to give you anything back. Just wondering if you think it’s a good idea to send them a stronger worded letter yet threatening to take court action or whether I should leave it for a bit longer?
    Sorry the post is a bit long but hopefully its quite a good test case as well, which others can read an hopefully this may help them.

  • I have recently had a reply from the Bank of Scotland regarding cc charges. These charges were roughly £100 in total including 8% interest I charged. However, only one of the charges I incurred was for £25. The BOS argue that they are only due me £13 (less OFT recommended £12) in total as all other charges were for £12. Are they correct or should I fight them for every charge I have incurred?

  • I have my Capital one account with a collection agency also. I sent a letter of complaint re charges in Dec 08. I have received a reply to my first claim letter and they are offering the usual lowest amount possible. I am in the process of now replying with the second letter from Martin's reclaiming charges article. After they way they have bombarded myself and family with constant phone calls I will chase them for every single penny !!!!!!! :mad: :mad:

  • This is a bit long winded but..................

    I had a credit card with Halifax and paid it off in 2003. At least I thought I did. I requested a figure to pay it off by phone and was told to pay off £6221.10. I did this and cut up my card. 5 years later I received a letter from a debt company saying I owed £390. They had given me the wrong figure and so my card was still open. It accumulated interest and late charges and I have to pay it as I had nothing in writing and the debt was sold on in 2006.

    To offset this I would like to reclaim all the late charges on the card. I have the statements from the debt company. Can I still do this for a card which was closed and sold on to a debt company? You might have to be a lawyer to answer this one but any help would be much appreciated!
