  • Success today:j Lloyds Tsb have offered me £514 as a final response. They only offered £80 in reply to my first letter but after following Martin's credit reclaiming article they have now offered me an additional £514, more than I was claiming in the start:rotfl:

    Thanks to this great site.

    :money: you are a STAR

Now to set to work on the rest of the dreaded cards !!
  • Hi
I started reclaiming process couple of days ago, I have sent Template Letter no 1 to my Bank with 10 GBP cheque . After few days I received a letter from HSBC:

'' I refer to previous correspondence with regard to information concerning transactions and charges on your account.
Please be advised that after checking statements from March 2006 to December 2008 I can confirm that no charges were found.
If you require more information, please let us know.
    Yours sincerely,

No statements. Just this letter. And above statement that no charges were found is not true !!!
They did not send me any statements but they did not have any pricks about taking my cheque !!!

I searched forum, trying to find similar problem but I couldn't find any threads.

Could you please advise me what should I do now?
Did any of you guys got the same response from your bank?

    Thank you.

    PROVIDER MBNA
    CLAIMED £1500 + INTEREST
    WON £900

I Claimed on behalf of my partner, He had three accounts with them over the years. This was the first time I had done this, but he had claimed £1600 from Halifax bank.

We got a letter saying that they would deal with the cases by blah date (it was about two weeks) which I actually thought was very nice of them. Then we got out responses early. (I was happy with this) We were happy to settle for the £900, we got two cheques and the one current card he has with them was credited with £389.

    PROVIDER HALIFAX
    CLAIMED £320
    WON £150

Not such a nice company. I got the first letter saying go away so I threatened to take them to court. Then surprise surprise they offered £150 which cleared the amount outstanding on his card and we have closed it. No more money to Halifax.

    PROVIDER SKY
    CLAIMED £275
    WON £138.50

Dead easy to deal with, you can speak to them on the phone, but again we got a letter to say that we would have a response by 28th of this month and the letter came today saying they will give us £138.50. Its more than enough to clear the card, another one for the bin.

    PROVIDER MBNA
    CLAIMED £200
    WON £91

This is my old MBNA card. The account has been dead for eons, but I though I'd give it a go. I am now just waiting for my cheque.

Having read some of the other threads on this site, I should maybe have hung on for more, but I am happy with the amounts we have had, it has helped to clear two credit cards in full, the £91 from this claim will pay my barclay card.

We are going after RBS next, then both of my Barcalycards. We have not found any negative response from any of the companies we have dealt with. I never had a lot to claim back as I had direct debits paying mine, but for the cost of a stamp and some computer time, go for it. Do not be put off with the first letter telling you to go away.

Stick to the letter templates on this site, they are tried and tested, but what is MCOL?

Thanks Martin and to your site, so far with his halifax claim, we have recouped nearly £3000. Its a hell of a lot of money and the New Year will be much easier for us now.
    Lucy

  • I have been offered £121 from MBNA on credit card charges. There is £277 in charges owing. Should I accept this sum? Thanks Wee Gina
  • I wrote to Halifax around 10 days ago claiming £397 for charges for the period 2004 - 2007. The amount includes interest calculated on the fees which were charged at £25 each.

I have just recieved an offer back from them of £143; this is the difference of the 11 fees (£25-£12(supposidly fair fee) = £13 x 11 = £143) Do you think I should accept the offer and be happy with getting something back or push them for the full amount including interest?

Thanks again Martin, it really does work!!!!

Push them for more. Point out the interest rates for 2004-2005.

    Hi everyone,

Ive recently put a claim to capita onle for a refund of the charges. Over the last six year period it equates to just over £1100. My card has only ever had a credit limit of £200 and although I do understand that I should have maintained the card correctly, I still think the credit companies do have some liabilty in overlooking the usage. I wrote to them, demanding a refund of the full amount with interest (roughly £1500), they wrote back offering me £331, which is basically refunding me the £8 of each charge and keeping the other £12 in line with the recent test case (each charge was £20).

I wrote back rejecting their offer stating my reasons, they have sine wrote back to me re affirming their original offer of £331. I would like to put a complaint through to the FSO, on the basis that my card only has a limit of £200, how can they justify charges to such a card, upto nearly 500% of the value??

Does anyone think It is worth a try?? I am angry that they were allowed to take advantage of me without taking any form of liability.

    Regards
  • i had instalment plan wityh co-op, but they got impatient and sent case to bryan carter & co.. original claim was sent to co-op in November..

(BCC tried adding on extra charges AFTER the ccj, but i told them where to go, and they have not been back to me since!)

ccj done, that paid off per instalments set by court (same as i wans paying to coop!)

co-op are now playing silly, saying they no longer deal with my (and their?) a/c..

here's my draft to Bryan Carter (i will be copying this to Co-op..)

...Co-op Visa Credit Card - xxxxx

I refer to the enclosed reply from the Co-op, in respect of my claim for refund of unfair credit card charges.

Their statement that they are no longer dealing with this account is rather puzzling, as it was the Co-op who supllied the statements that I used as a basis for my claim; They must have also requested / authorised any court action.

I do not believe the charges reflect the true cost to Co-operative Visa, and are unfair and disproportionate, so I am therefore requesting a refund based on the Unfair Terms in Consumer Contracts Regulations 1999.

This is supported by the Office of Fair Trading’s April 2006 statement into credit card charges, which noted that the level of charges at the time, and prior to that period, were unfair.

The charges total £180.00, plus £81.56 interest at 8% (statutory court rate).
Enclosed is a fresh copy of my claim, and a summary of charges that were applied on the statements supplied (charges covered period between Oct 2002 - July 2003; previous or subsequent charges and fees are not yet included).

Copies of the statements supplied by Co-op can be provided to you if required, upon receipt of payment of £10 per sheet. (this bit is a try-on, i admit- but they do it to us!)

Between you I am sure you can agree who should refund said charges, and I look forwawrd to receiving a cheque for the £261.56 total, within 14 days.

Please make cheques payable to xxxx. My BACS details are available upon request, should you wish to settle my claim direct.

    Yours faithfully...
