I think i have understood you! If you are claiming back charges that were £12 you will struggle i think. They were reduced to £12, this is what was deemed fair charges so the banks wont pay out if they don't have too.
With all due respect its nice getting a lump sum back from the bank, but please remember, they are banks and need to make money, when they pay out all this money for people that should run there account better, they will only find somewhere else to claw it back from. I know i sound like a cow, but its not meant like that. I claimed back from RBS and got £800+ but really i should have ran my account better.0 -

Hiya Wanted To Ask If Anyone Could Help Me.....capital One Have Closed My Account Just After I Asked For My Money Back And Have Forwarded My Account To A Debt Company...would I Still Be Able To Claim My Money Back?
I Sent The Second Letter Asking For Payment Almost Two Weeks Ago And I Am Now Awaiting A Reply Off Them...should I Still Proceed And Ask For Payment Via A Cheque As They Have Closed My Account?

Just wanted to say that i have started to claim back charges from the following companies
Barclaycard £1440.00 plus int of £268.99 sent 1st letter 30/12 received credit to my account of £288.00 plus int of £23.04 6/1
Letter received telling me thay had cridted my account 17/1
2nd letter sent claiming difference 19/1
Natwest £360.00 plus int of £120.20 1st letter 30/12
Offer of £144.00 6/1
2nd letter 7/1
offer of £144.00 plus 8% int total £155.52 15/1
Offer rejected sent leeter saying iI will take them to court for difference.
MBNA £1370.00 plus £239.06 int 1st letter 30/12
Holding letter received saying they will respond by 29/1
Will let you know what happens.0 -
I've had some success with both MBNA and Capital One.......however, CitiCards are being a complete pain in the !!!! - they sent me a letter on 14th November saying that they would be sending out my copy statements - heard nothing. Phoned them in December to chase them up - said there was a 'bit of a backlog' - Now still heard nothing - phoned today to speak to their Data Request Team and was told they dont speak to the public - the guy who answered took my details and said would look into it for me and comeback to me - not holding my breath - any suggestions as to how I can progress this - they have taken my £10...WARNING!Alcohol can make you think you are more interesting and attractive than you actually are.....0

Yet another newbie on the bandwagon here...Please be gentle...:p
I've had an egg card since around 2002 / 2003, having signed up online...No real issues for many years, and I had a small balance on the card which I was happy to pay off each month...
Alas, as time passed, I had reason to use the card extensively - I bought a business and used it for stock etc...
It reached the point where I now have a substantial balance on the card...And then the penny dropped that I was paying 'egg payment protection' of over £100 per month! :mad:
I (stupidly) hadn't noticed this up until 6 months ago, and cancelled immediately.
Anyhow, I had no knowledge that I'd agreed to take out such cover, and found some very helpful advice / form letters from this site.
I made a subject access request in early November, and received an acknowledgement letter several weeks later, stating I'd have the info by the 26th of December...
...Having reached the 8th of January without word, I sent a further letter reminding them that they'd breached the DPA, and I'd report them to the ICO if I didn't hear within 7 days...Surprise, surprise, the info arrived 3 days later...:rolleyes:
Anyway, I'm working away from home at the moment, and haven't been able to see what they've sent yet...I get back tomorrow, so will check then...
I fully intend attempting to reclaim my PPI - I didn't even know I had it, and my company pay my full wages for 12 months if I'm off sick...So I didn't need it in the first place!
Any top tips for dealing with egg? :A0 -

Hmmm - If you've made a proper 'Subject Access Request' for the statements (I'm guessing you have, as they've cashed the £10), they have 40 days to provide the information, or they're in breach of the Data Protection Act...
I had the same issue with egg, and sent a recorded delivery letter stating that they were in breach of the DPA, and if I didn't hear from them within 7 days with the information requested, I'd refer the matter to the Information Commissioners Office for investigation...The paperwork arrived quickly after that, funnily enough...
I'd take the same course of action, and follow it up if they don't respond, with a complaint to the ICO - http://www.ico.gov.uk/
They have the power to commence legal action, so most companies to tend respond one way or another...:p0 -

correct me if i am wrong with a data protection access request which is what you paid £10 for dont they have 40 days to reply
then you can report them to the information commission
dont know how to etc but sure someone will let you know how soon enough

Not according to Martin's 'Credit Card Reclaiming' article!
He says,- "Charges from before June 2006. Credit card charges from before this date will usually have cost between £30 and £35. With these, you can ask for either the full amount of each charge to be refunded or the difference between the actual charge and the OFT recommended fee of £12; for example, a charge of £35 minus £12 would give a refund of £23.
- Charges after June 2006. For any charges on or after June 2006, you were probably hit for £12 each time. As this is already set to the OFT recommended amount, you simply need to ask for the full £12 amount to be refunded."
