    hi all, i dont know if im in the right place, but is it still ok to try and claim for CC charges? im with the halifax, and earlier in the yr i won the bank charges with them, but didnt think about the CC charges with them..i have been on a DMP with payplan and they send regular payments to the halifax CC.. and the last couple of months, the interest has been unfrozen, and they are hitting me with late payments because i cant meet the minimum payment each month.., i thought that seeing as im willing to pay something each month, they wouldnt start hitting me again...at this rate, i will never be out of debt with them, as the total goes up each month.....ok maybe i was being naive at thinking that they wouldnt start hitting me again but surely they can see im in trouble and willing to pay....so, if anyone could advice me on if its not to late to claim......if i dont ask i dont get, so nothing to lose really.....

  • There is no reason why you shouldn't claim back the cc charges from the Halifax Arthurdick. You have already had success with your bank charges so you know that they are willing to refund. I don't know anything about agreements under DMP's so I can't help on that front but as you say, you've got nothing to lose so go get em!

    First wrote to capital on aug 08 got no where

    wrote to fos on 18 nov 08

    got letter from capital one on 22 dec 08 saying they would pay £846 + interest= £965.79 and it would take three weeks.

    recieved cheque for £965.79 today 29 dec 08.

    brilliant great cheque to start the new year

    just need the bank charge thing sorted out now then i will be happy

    Just wanted to say if it wasn't for you guys and that Martin fella I wouldn't know anything about ppi mis-selling or what to do about it. So feeling brave we are in the process of claiming back ppi on credit cards and loans due to OH being self employed and not really understanding what it was all about.:confused:

    Halifax credit card and MBNA credit card are looking in to it.

    We've had a two fingered salute letter from Monument saying Payment Break Plan isn't insurance and you were enrolled on the plan during a telephone conversation before account opened in 2004. It was up to you to cancel as it was optional. I am writing back for details of this telephone conversation as the only time you phone these companies up is to activate your credit card and often it's an automated service. So have no recollection of any kind of conversation with an advisor.

    Barclaycard have done the same, replied that July 2004 you ticked box for ppi on application form, had 30 days cooling off period and it was up to you to read if it was suitable. They are sending the original application form to show he ticked the box.This is their final response.

    I'm not sure what to do next, my original letter was similar to the template on here and we believe ppi has been mis-sold due to him being self employed and certain exclusions apply only paying out in death or bankruptcy.

    Do you think it's worth pursuing Barclaycard still?

    Is it correct that i can only reclaim Credit Card charges within the last 6 years?
    If the charges are unfair and i have the statements to show these charges, why can't i claim back charges outside of the six years?

    I am considering this very question concerning the six year limit.

    I am aware of the statutory limitations, however, let me construct the following argument based on the fact that I had NOT paid off the balance completely directly leading into the six year period.

    Therefore I was accruing a proportion of interest charged on the outstanding balance that contained the charges and interest debited prior to the six years. As a result I could argue to the court that as the card company was contining to charge me on those debit, to which I am claiming back, are debits to the account proir to the six year limit then I should be able to claim them back.

    The fact that the CC companies do not seem to have records should not negate the ability of me to be able to make the claim.

    Furthermore is a creditcard aggrement a running contract renewed monthly or a contract whose contractual start date is evidenced by the individual debit date?

    any more thoughts anybody?

    Hi

    Am in the process of claiming back CC charges from Nationwide. I've gone through the online small claims court proceedure and it was passed to my local Court. I was then told the claim had been 'stayed', pending the outcome of the bank charges hearing.

    Wrote back, filling in the appropiate N244 form and paying the £75 charge. Have now had a letter telling me the request to have the 'stay' lifted will be heard on 20/2/09. Is this the correct proceedure?

    I understood that the stay would be lifted and then proceedings would continue. Does anyone know if this means that when the stay is lifted, which i'm assumng it will be, will i then have to wait for another date for the claim to be heard?

    Have successfully claimed £8 (so much(??)), but better in my pocket than theirs!!) for over charging late payment fee on RBS credit card. Wrote to Northern Rock about a late payment charge on a credit card, but received a letter from CoOperative Bank. Did they take over the credit card side of the business? Still waiting a response.

    I know it is only small amounts, but as we say, every penny counts and better in our pockets than theirs...
