  • I have a Natwest credit card on which I have been charged 10 over limit/late fees at a value of £12 each time. I wrote to Natwest asking for the charges to be refunded and they replied:

    "This charge is in line with the Office of Fair Trading standards. As such these charges will not be refunded."

    So are the charges lawful? Is there any point me pursuing the claim? If so what should I do next? They said that I could refer the complaint to the Financial Ombusdman if I want.

    I would refer to the FOS. It wont cost you any money, so you have nothing to loose and all to gain.

    Can anyone help me with my previous query. I keep coming back to this board, but no one is answering me. :(
  • Can I still go ahead and claim these charges back even though I'm in a debt management plan?

    I'm only taking a guess here, but if you are financially struggling then I would have thought that you would be more eligable to claim credit card fees. Under the bank reclaiming I would have thought you would be eligable for 'hardship cases'.

    In any event get the ball rolling. If you dont ask you dont get. Good luck

    I was thinking along the same lines, but we actually don't have an awful lot of charges. We went from meeting minimum payments almost straight into a DMP, so incurred three late payment fees (£12) for each of the credit cards. The total would be I guess £360. Quite a bit, but not a massive amount.

    The problem i have is, so far only Nationwide have gone for, and got, a CCJ, and as a result we incurred the court costs. If I go ahead with reclaiming the charges, we could end up worse of if that request upsets the rest of our creditors enough to go for a CCJ. On top of that, all except Nationwide have reduced the interest - 7 to 0% and 2 to 6%.

    I thought you were supposed to request full printed statements (which is why it's £10), and then you would have the full date sand all the info you need - they can't remove charges from an official statement!

    I've had the same response from Mint - just a table of charges and the month rather than a specific date. I calculated the interest using the 1st of the month - if they don't like this then it's upto them to give a more specific date! I'm claiming £168 (Inc interest) and got an offer today of £48. Have just written 3rd letter to them asking for full amount or I will take court action.

    I think I'll wait until my court hearing with Nationwide is done, then go for the rebate. It's only about £50, but after the way they have persued me recently, I'll go for every penny from those sharks!

    Hi All,

    I am at the same stage with MBNA, they have responded with a letter saying that they would respond to my 14 day refund letter by the 28/12/08, when in fact there 14 days are up on the 12/12/08.I have put in for a full refund of all charges from 2003 that amounts to £1945.00 including interest! Should i wait until this date they have sent me or respond:confused:
