    I am about to mount an assult on MBNA, GE Capital and possibly Capital One for the refund of charges to CC's. I have picked up on one or two of the comments posted that once MBNA refund the charges the account is closed. We have about 5k on the card and am paying monthly on DD but the card was withdrawn so we obviously wouldn't miss it, but I'm a bit worried that they may demand immediate payment of the outstanding balance. We can't come up with that kind of money and are unlikely to be able to get another CC to tranfer balance at the moment.

    Is it possible that they will demand immediate payment and if they do, do I have a leg to stand on?. Any advice would be most appreciated.

    hi , i claimed back my charges on my mbna card early this year got all the money i was asking for which was about £1,500, they paid the money back onto my account as i still owed them money , still do so no they wont close ur account, so go for it , good luck jill

    Hi I sent the relevent letter asking for copies of statements at the end of Sept, I then sent a reminder letter beginning of Nov, I have had no reply from Marbles whatsoever. Should I send another reminder or report to Infomation Commisioner now? By the way I did include the £10 fee.
  • Dont know if im on the right thread but here goes anyway.
    Posted martins 1st letter to mbna asking for my statements along with a cheque for £10.00. Recieved a letter today from them saying that "The Relationship they had with my former army regiment ( ie Regimental credit card) has now ended. The decision means they are now no longer able to provide any details on this account." My last payment to them was only 2 yrs ago, but they said they will transfer me to another account ( no thanks).
    They also kept the cheque///now what :mad:

    I've recently returned after being away for four months and discovered on my return that Egg, I've an Egg Money account, have charged me four times, once a month for four months, for going over my limit. Aside from the first time, this was not due to any activity on my part (I hadn't used my card at all whilst I was away) but because my card was set to 'minimum repayment' and the way their system works meant that each time they charged it took the money from my other bank account, but too late, and caused me to be charged again the next month for being over the limit due to the charge. I think this is all very unfair, but I am unsure the best way to go about rectifying it. Specifically, whether I should complain that the three later charges are utterly unfair as they were caused by their system or take the line that all credit charges are unfair and demand a repayment of all of them or some combination of the two. Any advice or suggestions would be very much appreciated.
  • Hi all....read this !!

    After making a successful claim for the whole amount against Capital one, i have a question concerning defaults.

    After checking my credit file, it would appear that Capital one had registered a default against me as the account with them was and had been overdrawn for some time, BUT this was purely due to their unfair charges, which at the time i could'nt afford to pay off. The amount increased over a period of time and was eventually sold off to another finance institution.

    Now that i have received my charges back and subsequently paid off the amount owing to the institution (which was sold to them from Capital one), would i be entitled to get the default removed ??? Surely by getting my charges reimbursed, Capital one are in a sense admitting their charges are unfair and therefore should not have defaulted as a result ???

    Anyone else in a similar situation, please advise me on whether i would have a leg to stand on or if i'll be wasting my time.

  • Please can someonehelp, noone got back to my last post. Capital One say they can not find my account even though it is under 6 years old and i have statements from them which i sent to them but still no luck.

    I also had a corporate amex card, which went in to arrers and i had to pay back thousands and when requesting statements they told me it costs £10 per statement which works out as over £120 is this correct?


    I was told this when I first called Lloyds for copies of statements. I just stuck to my guns and explained that it should be £10 total fee for all statements and after trying to argue the guy on the phone told me to send my letter and include a £10 cheque and he would see what he could do. Surprise surprise it was fine and I got my statements in a couple of weeks!
