Hi there! I am also on a debt management programme and have claimed sucessfully from Abbey National and Halifax. The only thing to watch out for is that the money will go to settle any outstanding debts.
Another thought is that I settled with Abbey two years ago via a third party for a reduced rate, as Abbey had soled my debt to the new company I was able to re-claim in full without them deducting the difference. With Halifax, they still hold my debt although they have a third party collecting for them. Therefore they could ask for the difference for any lesser settlements you have already achieved.
Claim for the whole lot plus interest including any £12.00 charges. Its very easy!

Hello everyone.
I've gone through the process and used Moneyclaim to take Beneficial Bank. Now I've taken Capital One to court twice and won so I'm used to this (or so I thought).
Beneficial, instead of caving in, shock horror - defended the claim:eek:!
I've now a court letter asking for the allocation questionnaire to be dispensed with (which I think means we don't need it). However, I got this letter/document a month ago and I haven't heard anything else since. I've gone on to the Moneyclaim website but they've said that I can't do anything with it right now.
Has anyone reached this stage before? What do I do now?

Hi,
After receiving an offer of the difference between £12 and charges from Barclays card I sent them a letter stating that I did not agree with their charges etc etc and would commence procedures through FOS or MCOL to reclaim full charges if not heard anything within 7 days.
I have now received a letter stating that my correspondence is being dealth with and they aim to resolve matters by 21st November! Should I wait for their response or just proceed with court proceedings?

Can you claim charges back for open accounts which you owe money to, for being several hundred pounds overdrawn in? Its hundreds of pounds worth of charges anyway!

Please can someonehelp, noone got back to my last post. Capital One say they can not find my account even though it is under 6 years old and i have statements from them which i sent to them but still no luck.
I also had a corporate amex card, which went in to arrers and i had to pay back thousands and when requesting statements they told me it costs £10 per statement which works out as over £120 is this correct?0 -
I've had an MBNA Visa card for at least 5 years, but the PPI payments have been getting on my nerves. I didn't select the insurance myself, so presume the box was already ticked and it was up to me to untick it. Is it worth me claiming for this or will they say it was my own fault for not checking the form properly?
I did have a sucessful payout from Studio for over £200 for their high late payment fees. This was due to the excellent advice on here so I hope I can have similar joy with MBNA

You should CAP1 again, fax it while you are on the phone, if still no joy, report them to the Ombudsman!
Amex should only charge you £10.00 per request for a personal card!0 -
morning all.
Over last few months i have been using a company called Oasis, to help claim back my charges on a halifax c/card, with their help i got £174 repaid into account. Then with help of the Financial ombudsman service, and Oasis I made a successful claim for PPI. On Friday just gone, I got a letter from halifax, attached to this was a cheque for £971, I could not get out of the house fast enough to get it cashed. This has helped pay off some of my important bills, like electricity, I also have enough money to pay for my Bankruptcy petition, due to debts to high I may never get them paid, due to unemployment. I encourage others to fight for what is yours, do not let the banks get away with it. Good luck to those just starting their claims.:T0
