Would I need to wait for land registry to update the title to remove my name before I can complete on the house I am purchasing? Or will confirmation from the lender that my name has been removed from the mortgage be sufficient? Everyone in the chain is just waiting for us to confirm a completion date but we are unable to until I know my name has been removed!

Hi,
I am currently selling a shared ownership property and buying another shared ownership.The buyers solicitors have been very very fussy so far, they have raised over 60 enquiries. We are now at a stand still as although the my Leasehold is registered on Land Registry and the Housing associations Freehold is registered, the buyers solicitors are now not willing to complete due to this: ' although both the leasehold title, and the freehold title are in order - the leasehold interest is not registered upon the freeholds section C charges'.
my solicitor is stating that this is completely unnecessary from the buyers point of view and have offered an indemnity policy to the buyer but they have rejected it.There are 6 properties ahead of mine in the queue to do this on the land registry and my solicitor said expediting and skipping ahead of the others isn’t possible.Keep in mind the property I am purchasing is on the same estate and are 1 head of me in the queue to be added to this register too….. yet we are ready to exchange and complete without this?
Are my buyers solicitors being unreasonable? Is there a legal reason they won’t proceed to exchange/completion without this? Why would they reject an indemnity policy when all buyers/sellers in the chain are ready and wanting to exchange/complete?Any advice if this has happened to anyone else and how it was resolved?Thanks0 -

Expedition can hasten the earlier ones too so always request it. If you don’t then it could be a very long wait

My mother, sister and I owned shares in a property. My mother has recently died leaving her share to my sister. I understand that the Land Registry are not interested in the distribution of the beneficial interest and that a DJP form is all that is required to remove my mother from the title, leaving my sister and I. Is that correct?
The second part of the question is that my sister will then buy my share of the property. I understand that my sister and I will need to transfer the title to my sister only, using a TR1 form.
I am concerned that if the TR1 form is submitted before the DJP is processed, which I understand can take many weeks, this may create a problem as my mother will not be named as a transferor on the TR1 form, but may not yet have been removed from the title. Will we need to wait until the DJP is processed before we can submit the TR1? Thanks.
