  • Hi @Land_Registry, I sold a shared ownership leasehold flat last July, there is 2 titles involved (AGL436135, AGL432233) as I sold my share to a full owner who bought it outright from both me and the housing association. I know the processing takes a while, and I won't get notified, but I keep checking back and it hasn't been updated yet. I wondered if there's been any movement on it, or if it's just in the system somewhere? I'm really worried about service charges etc. coming back to me if it doesn't get updated - I signed up for property alerts, and I think the only one I've had is for my mortgage charge being removed.

    The two titles relate to separate leasehold flats 27 and 28. I’m guessing your are 28 as that’s the one we’ve had a charge removed from. 
    But nothing since so best check with your conveyancer as to what’s (not) happened

  • That's very strange that the title is for the other flat - I'm now worried that the wrong number has been put on the TR1 form. There are 2 titles though as I think one was the landlords and one was mine...the solicitors assured me it was being done...now I'm not so sure.

    I checked the landlord’s title too. Ask them to confirm the title number AND our ABR reference - the latter will be the giveaway re lodgement (or not)

  • Thank you - as the seller do you think I should be worried about it? I could understand if I was the buyer, but other than a paranoia about bad admin I'm not sure it makes much difference?

    Hi, I'm looking for some advice. We're in the process of purchasing a property from my partner's mum. She inherited the house 8 years ago from her parents and has allowed us to live in the property since. She has never lived in the property.

    Were buying the house for 150k, which is around 60k below market value. The house was valued at 175k when we first moved in, so we know there will be CGT to pay.

    My partner's mum added her husband to the title of the house recently, but he is down as a co-trustee on the deed. This was on the advice of her solicitor, as doing so should save money on the taxes owed. The solicitor explained that it was common practice and all above board.

    Our solicitor disagrees though and says she will not put forward our application to the land registry as it will be rejected. We are at a stalemate, with both solicitors refusing to budge.

    My partner's mums solicitor wants the sale completed by Thursday, otherwise there will be extra tax costs due to some sort of deadline expiring. Can anyone advise whether the sale would be rejected by the land registry based on the above?

    Hi @Land_Registry, I’m in the process of selling my house (3.5 years old, bought from new) and I had a call from my solicitor today to say my property is still not registered in my name. The last correspondence I had with my old solicitor was in 2021 saying they were processing it but boundaries had changed to which I confirmed I was happy for them to proceed. 

    I’ve read this can be expedited but that it has to be done by the original solicitors who dealt with the sale. My new solicitor has expedited it herself today, will this get approved?

    It’s nothing to worry about as the seller but it would be prudent to follow it up with your own conveyancer. The buyer may be waiting for certain paperwork before applying but that seems like a big gap between completion and application.

    From a purely registration perspective the transfer has to be by the registered legal owner(s) as appropriate. 
    CGT and taxes owed don’t impact on registration requirements 
    So it’s unclear from the details shared what the reason for rejection would be. I imagine there’s something more specific involved
