Can I request an update on an adverse possession application please? Title number CYM860947 Ref: 230112-1579015
We applied on 12th January and our application was expedited, but we haven't received any correspondence and our solicitor is struggling to get an update. We would just like to know if the letter to the registered owners has been sent yet if possible.

When the Council sold the property back in 1986 they imposed restrictive covenants on the buyer.The separate covenant just links the owners to the same covenants.You’d need to read the Transfer (apply by post - see link from online service guidance you used to get the register) - to understand what the covenants are and how they restrict you.Such covenants are imposed for the benefit of other land/property owners often on the same development/estate. Not the Council unless they still own benefiting land/property on the development/estate
To what extent they actually restrict any of your plans is something to consider and discuss with your conveyancer.
Is the Transfer document something that I could order online from your portal? I am unable to find this document anywhere on your website (the only documents available are the Title register and Title plan). While I could probably leave this to our conveyancer to find themselves, for our peace of mind, I wanted to do our own due diligence (plus for our own education!).0 -

Good evening, I am hoping you can help.
We are looking to apply to have a Form A restriction removed from a title as there is now only one surviving proprietor. I understand we need to use RX3, supported by a Statement of Truth ST5.
This statement will declare that nobody else has a beneficial interest in the property due to the deceased’s estate being settled previously under intestacy rules.Originally there were 4 beneficiaries of the deceased’s share. Only 2 beneficiaries are now alive who can declare this and provide evidence. (The sole proprietor ‘bought out’ the beneficiaries with the cash value).My question is whether the statement can be signed by these remaining surviving beneficiaries only? Or will we need to track down the families of the other 2 deceased’s beneficiaries to complete the declaration?I hope that makes sense, I’ve tried to keep a complicated story simple!0 -
