Hi @Land_Registry, I’m in the process of selling my house (3.5 years old, bought from new) and I had a call from my solicitor today to say my property is still not registered in my name. The last correspondence I had with my old solicitor was in 2021 saying they were processing it but boundaries had changed to which I confirmed I was happy for them to proceed.

I’ve read this can be expedited but that it has to be done by the original solicitors who dealt with the sale. My new solicitor has expedited it herself today, will this get approved?

    Thanks!
If you have a confirmed buyer then yes
Thanks, yes I do have a confirmed buyer. Do you know how long the expedited application could take at the moment?

Hi, my neighbour has a right of way across our property, to a shed he owns, he has owned his house since about 1990 so his deeds are not held by the Land Registry. He has started using his right of way at all times of the day and night to harrass us, there is nothing in our deeds about his ROW so how do we find out what his rights are i.e times he his allowed to use it etc.

If it’s unregistered, and your title makes no mention, then you are reliant on him to prove the right exists in law. To start with you’d ask him to provide legal evidence that the right exists.
Clearly if he’s harassing you it seems likely he’ll say No and you need to then seek legal advise. Such advise may simply involve your solicitor writing to him to ask the same Q but it moves matters to a new stage.
Advice is always to try and resolve matters amicably but if it’s being used to harass then there must be wider reasons behind the harassment that also need resolving
So he could write his own deeds, how is there any proof that they are legitimate, I think he might still have a mortgage, would a solicitor or me be able to get a copy of the banks copies.  Do the Land Registry know who owns the property, i.e which bank What if he ignores a legal letter, this all seems so unfair.

Expedition gets it looked at generally within 2 weeks. Then it’s all about it being in order

How? If they’re not registered then there can be an issue. Whilst I understand your concerns it seems to be more about the harassment than the ifs buts and future maybes
His actions may or not be harassment. Legal advice will confirm. If they are then the legal proof re access etc is his defence. And any defence needs an arbiter and that’s a judge. But your legal advice/assistance is next step and then worry about what’s next based on what that advice provides.

    Good Morning again @Land_Registry

Please can you help us out with title SF295610 - an expedite request was apparently put in on 23rd February but the title still hasn't changed over to the current owners - I last checked with yourselves on 20th March and it was still with yourselves as you had requested more information from the conveyancer on 13th March.  Can you advise whether there has been any further movement please?

No further movement as still waiting for more as per our request. I suspect the conveyancer is reliant on third parties to provide the ‘more’. You’d need to contact them to confirm.

Thank you. I’ve found out this morning my current solicitor and my old solicitor have both expedited it (as I reached out to my old sol on Friday to find out more) - will this be a problem?

No. It’s only one application so once expedited asking again doesn’t change things.

TR1 is the legal deed but you’ll also need AP1 and ID1/ID3 as appropriate as the two of you are transferring to just the one
