There’s no requirement as to number of applicants as very sadly the death/update is factual. So it can be just one, all or someone else

My mother, sister and I owned shares in a property. My mother has recently died leaving her share to my sister. I understand that the Land Registry are not interested in the distribution of the beneficial interest and that a DJP form is all that is required to remove my mother from the title, leaving my sister and I. Is that correct?
The second part of the question is that my sister will then buy my share of the property. I understand that my sister and I will need to transfer the title to my sister only, using a TR1 form.
I am concerned that if the TR1 form is submitted before the DJP is processed, which I understand can take many weeks, this may create a problem as my mother will not be named as a transferor on the TR1 form, but may not yet have been removed from the title. Will we need to wait until the DJP is processed before we can submit the TR1? Thanks.
Correct and correct again. But you don’t need a form DJP application as you can do it all under the on application
Forms AP1 and TR1 plus your identity verification using forms ID1/ID3 as appropriate
You submit those along with a certified copy of the death certificate

Perfect thank you. One last thing... even though the transferors are both my sister and me, do I check the box "the transferor has received from the transferee..." in Panel 8? Thanks again.

Help Required - I am currently trying to get a second charge removed from my deeds. The loan was repaid 2017 and we are having a hard time getting it removed. Is there a legal responsibility on the loan company to remove the legal charge when the loan is paid as we have 2 charges one with First Plus and one with Elderbridge who bought the debt from First Plus. Elderbridge have said they can ask First Plus to remove their change but cant make them as there are a different company. Also would anyone know the process re getting second charges removed from your deeds in Northern Ireland and is it possible for us to get the charge removed by ourselves if we show evidence the loan has been paid.

Northern Ireland have their own registration system so you’d need to contact them re their requirements
In England & Wales you’d need supporting evidence that the charge has been paid off and released by the lender. There’s no legal obligation for them to remove it but most do if paid off. The option to go to court exists though if necessary if there’s an argument over whether paid off or not

Hi Land_Registry not sure if right place to ask but I am in the final stages of purchasing a property and I have noticed the official copy (Transfer) document dated from 1990 shortly after the property was built shows the construction company transferring the land & title to the new owner at the time.

The document title number is correct and the plot number it was built on is correct and a match but the house number is Incorrect stating next doors number.

I have spoken to my solicitor regarding this and he says it will be a long drawn out process to correct this document even though it is clearly a clerical error. He says all original parties would need to be contacted that may not be alive/trading still and also the local council.

Should I be concerned about this document being incorrect as we are due to complete next week? How important is this document? The Official Copy Of Registered Title is correct with correct address, The Title Plan is all correct and a match for the building plot on the transfer document its just the house number on the transfer document that's wrong. The property title number is correct across all 3 documents. He seems happy for us to proceed but isn't being overly forthcoming on his answers.

I think what I am really asking here is can the land registry correct this document? or would we need to contact all previous parties named.

And also would the next door neighbours who's number is on the official copy transfer have any claim on the property we are purchasing.

    Thanks

You need to rely on your solicitor here. In very general terms it would be very unusual to try and amend such a deed in the circumstances you describe. It’s a Transfer of the property/plot in all but the number you refer to. There’s highly unlikely to be any issue re that and I can’t see how a neighbour would be able to claim ownership on that alone.
It reads as being a very minor point but as stated very much for your solicitor to advise on and allay your fears
