    See what happens today. The buyers agreed to buy the house based on the current boundary after all. They weren't aware that the garden was actually bigger than anyone thought.

    Hi - the 'title deeds' for a registered property are in essence the register and title plan which we hold electronically Search for land and property information - GOV.UK

    The linked guidance explains how to order an official copy by post and goes on to also explain how you can also apply by post for an official copy of a 'filed' deed, as referred to on the register itself, for example.

    Before applying for an official copy it's important to ascertain/understand whether that's what you need. The online option and search service provides you with a useable copy of both the register and title plan and for many that's all they need.

    I have the Title Deeds of a property, it has the following on it:

    A. PROPERTY REGISTER

    1 (date in 1992) the freehold land shown edged in red on the above title filed at the registry and being (XXX- address)

    2. (same date 1992 ) the transfer dated (date 1992) referred to in the charges register was made pursuant to Part V of the Housing Act 1985 and the land has the benefit of and is subject to such easements as are granted and reserved in the said deed and the easements and rights specified in paragraph 2 of schedule 6 of the said act.

    Note: there are no matters contained in the conveyance dated (different date in 1920) referred to in the fourth schedule to the above transfer that require an entry on the register.

    B: PROPRIERTORSHIP REGISTER

    C. CHARGES REGISTER

    1. A transfer of the land in this title dated (same date as above 1992) between (1) XXXX (local council) and (2) person X (I'm guessing the first owner) contains restrictive covenants. Note original filed.

    then there is another charge that is my mortgage company, dated my purchase date.

    —-I'm looking for what could be evidence of rights of way across the property. Would that be in the easement or would it be in restrictive covenants? And if so, how would I get copies of them?

    Rights of way are easements so if any are registered it's the 1992 Transfer you need a copy of. You can apply by post for a copy and for a fee

    I am dealing with a neighbours probate affairs etc

    Family member was a tenants in common. I am aware of what is needed for doing that

    They wish to remove the restriction when third persons share is transfered to one of the registered owners as per the will

    I am always aware of the forms needed to remove the restriction from tenants in common to joint tennants

    What I would like to know is can the forms for both be submitted at the same time or do I need do the one then when thats done do the other..

    They can all be submitted at the same time - forms AP1, TR1 and ID/ID3 for the transfer of legal ownership and forms RX3/ST5s for cancellation of the form A restriction

    You can't transfer a share as the legal ownership is always transferred as a whole so do bear that in mind
