    Thanks, we don't actually know if it has ever been registered. Her father inherited it from his father as I understand it.

    Check online for registered information. If unavailable then very likely to be unregistered

    Hello @Land_Registry , we completed a purchase of a property at the end of last September, title no. EGL271855. I haven't heard anything from HMLR since and it's been 4 months. So I wonder if everything is alright with our application to update the registry? Can you please check the status of the application for me? We also made an enquiry with the contact form on the HMLR website.

    The application is still with us (submitted 20th Oct) and processing should start soon. 
    The average wait time for this type of application is around 4 months but your conveyancer can check/confirm matters online and it will be then who are notified of completion or any reason for delay 
    The 12+ months Slithery refers to is with regards a very different type of application. But the ‘nothing to worry about’ is correct here

  • Round and around - Can you help LR?

    I've put a number of queries on here about a charge on my deed. This is the short version; bought my grandfathers house, with the process overseen by a solicitor with conveyancing documents signed and registered also with LR. Grandfather died in 2006 and I have struggled to get the charge removed ever since. He is annotated as the lender on the deed (with me as the 'owner'), where i have paid for the property (bank statements to prove, also with a letter from my grandfather confirming i have paid). Is this not a case of simply compiling the documents and sending to Land Registry to confirm this is the case? I have asked another solicitor to undertake this task, as i have had so many different interpretations of what i can and cannot do, at great expense to date. I am at the point of simply giving up, so any comment hugely appreciated.

    Charges are discharged using a form DS1 executed by the lender or someone with the legal authority to do so, namely their executor or a judge 
    In your case it reads as if you need probate for your grandfather and then his executor executes the discharge 
    That’s all very routine so why hasn’t probate been obtained to resolve matters?

    Hello, @Anon98 we are currently dealing with the same issue, the current occupiers have owned the freehold property for 15 years and were unaware of a noted lease, and now we are ready to exchange and complete but being held up by the noted lease of 99 years dated 1967, we have been offered an indemnity policy but our solicitors have advised against it, and so we are hoping it can be sorted, so I wondered whether the noted lease was determined for your purchase? I'm finding it difficult to get any info on similar experiences and the impression I get is that our solicitors and the sellers solicitors are unsure how to proceed too, thanks.
