I wonder if you can help point me in the right direction, about 12 years ago we bought my mum and dads house off of them, but paid for it over 9 years so had them listed as Lender at Land Registry via the solicitors dealing wiht the sale from them to us. We show as the Registered Owners but my mum and dad show as Lenders. Once we'd finished paying them we didn't realise we needed to get them removed from Land Registry so they are still showing on there.
Unfortunately they both passed away last year and so I can't get them to fill in a DS1 to get the charge removed. We did not need Probate as their estate was so small and they owned no property, so can you advise how I can get the charge removed at the Land Registry, everything I see online talks about removing Proprieters once they are deceased, but I can't find anything to remove a charge once they are deceased. I am their next of kin and the Executor of the will.
Any help you can give to point me in the right direction to ge the charge removed is much appreciated

MandyI’ll flag with colleagues and ask them to consider expediting based on your comments made here but please do double check matters with your solicitor also

My solictor has got back to me this morning saying he has double checked and sent me a screenshot of the application being approved for expedition. Unsure if this possibly as a result of your action? Could you confirm for me if that is indeed the case that this is now expedited just so I have peace of mind. Can I expect turn around time to be 10 working days as advised on the website?

MandyWell over 60% of this type of application needs more either from the solicitor or wider checks by ourselves. Your solicitor can check progress for you in the same way they’ve shared a screenshot - you should expect it to be considered within the 2 weeks but completion can take longer as explained.My advice is to check again with solicitor next Monday to see what stage it’s at or if completed
Still waiting on updates, but I wanted to ask if you can clarify what the actual type of application it is that is pending? I assumed it was a simple ownership derails change after the sale of the upstairs flats as we hold each others leaseholds/freeholds, but my solicitor keeps saying it's a request to split the Freehold which doesn't make sense as I surely its already split? Sorry but really losing my hair about this and what's actually going on. Really appreciate all your help!

A solicitor I spoke to talked about a 'Statement of Truth' but they want to charge about £400 for that, by the sounds of it though that wouldn't be enough as I'd still need Probate from what you say. I'll get that sorted and then complete and send the forms you mention

Totally worried about our house sale falling through! I am currently in a moving chain and the property we are buying requires a first registration for a strip of unregistered land before we can complete. I am really stressed out about the prospect of losing our house buyer as his mortgage is due to expire in March (his offer was accepted back in Sept 2021). The vendors solicitor have submitted the application MM166212, are you able to see how long this process will take. Thanks0
