    Good morning.
    I think my vendor is actually trying to ruin my life. I have been waiting three months for them to update their title to include a parking space which they forgot to register when they bought the house. Title number NT562987. They have now in fact registered it as a garage when it’s just allocated parking. Does this need fixing before the sale goes ahead of does the wording not matter. How can this be fixed if not? Will it need an entirely new enquiry or just updating their previous enquiry? What is the timescale for the resolution?
    If it’s a simple amendment then not too long

    What they own is a bit of land. What's on it is generally irrelevant to the Land Registry.
    Very true but in this case it’s the mortgage lender they are trying to satisfy I believe

    Morning 
    I’m trying to find out a likely timeline for an answer to a query over title deeds/map search accuracy. My (buying) solicitor asked the question as the sellers wouldn’t, under CU103456. The sellers solicitor has now asked the question as the land registry (quite rightly) said they would only deal with the current owner. I and my solicitor don’t know if they’ve used the same ref no. or not. The house we’re looking to buy has parking spaces and garden which don’t appear to be on the map search, and the deeds are so small scale it’s difficult to tell one way or another. Our solicitor is seeking clarification. 
    It is a long story getting to this point - our house sold a month ago so we’re staying with family until this gets resolved, so are anxious to understand how long this might take to help us decide next options. Any information would be much appreciated.

    Contact received 7th June and referred to be considered and replied to in the coming days 
    I assume they are trying to sell more than is registered to them although you don’t refer to the title plan in your comment. 
    The title plan is key here rather than MapSearch, which is simply indicative, or a Deed plan which doesn’t relate to what’s been conveyed/transferred previously. 
    Hopefully we can unravel it for the seller’s conveyancer and satisfy their needs/understanding and it doesn’t require any actual amendment to the registered extent, namely the title plan

  • Thanks for the quick response. I think CU103456 is the title plan number - which is quite a small scale so is difficult to confirm either way. Hopefully we’ll hear something via the sellers solicitor next week.

    That’s the registered title number so includes the register and title plan. I assume you’ve looked at the property and someone has raised concerns that all that’s being sold isn’t included. 
    Hopefully the scale issue is the key here and just getting the right perspective of what the title plan (not MapSearch or Deed plan) shows. Less is hopefully more here as looking at the other information rarely helps but it can cause doubt in some cases

    Our solicitor is wanting to just clarify what’s included in the sale as the plan is such a small scale and they’re concerned that the seller doesn’t legally own the parking/garden. The house is surrounded by farmland so there isn’t a neighbour saying the land is theirs and it is very obvious when you see the property that the parking/garden belongs to the house. That’s why they looked at the map search hoping that would have more detail. I agree that it is probably the scale that is causing the concern.

    Understood and appreciated. MapSearch won’t give more detail so a forlorn hope but I do appreciate why they might do so. 
    A better step may have been a search of the index map using the current OS detail to confirm matters re the being sold extent to confirm it’s all registered under the title. That would have highlighted any MapSearch uncertainty and corrected it. 
    Easy for me to say from afar though but they’ll get a reply soon I’m sure
