    They enquired on 7th and they were advised that it’s been referred on 10th for someone to check and reply. So they are still waiting but hopefully they’ll get a reply soon

    That will depend on H2B and how quickly they process it and how they then apply to remove it. I suspect it will affect your new mortgage but your new lender will have to answer that one. 
    The key is getting H2B to get it sorted ASAP and go from there

    Hi Thanks for your reply. Any advise regarding why the purchase price would still show old price in the title even after my solicitor raised it for the correction in June last year? I can see the updated price shows in the sold prices website/data but not in the title.

    Hi

    My parents are needing some advice and I hoped you could help.

    They have owned a property for over 20 years which they rent out, all registered with the LR etc, with a title plan showing the area of land they own. It is a semi-detached with small yard at the back. The back boundary is a cliff face which is terraced, and on the terrace (which is about 20 foot high) a wall is constructed. It runs behind both my parents property and the attached neighbours property. My parents and their attached neighbours do not own this terrace and wall and there is nothing in their title deeds indicating this.

    Their other next-door neighbour (detached property) owns this area of terrace and wall and it is documented on her paper title plan. Her property and garden are currently unregistered (she has lived there 40+ years) but she has now decided that she wants to register it. However, following advice from her solicitor, she has decided that she is not going to register this area of land behind my parent’s property even though she owns it. What my parents need to know is can she legally not register an area of land even though her paper deeds show it? And if she can legally not register this land does it mean she no longer owns it and therefore absolves her of any responsibility for it? My parents are worried that if she no longer has responsibility for it what would happen if this wall collapsed and damaged their property, or worse still injured/killed someone.

    We purchased a property in September 2020 and it's sale is still not showing in the land registry. Is this the norm?

    Hi, any advise on timelines (approx) on how long it will take to remove a help 2 buy charge from the title after Homes England have applied to HMLR with an e-DS1? I have a remortgage pending and just need to give some date to my lender's solicitor to not chase me until then.

    It can be as some types of application are waiting several months before processing. If you completed and the application has been submitted then it’s just a case of waiting until your conveyancer confirms it’s been done

    Some are electronic so are removed instantly. If they’ve lodged it in another way then several weeks wait. Do you have the title number as some lenders won’t wait if you’re remortgaging

    Yes is the answer to your first question. Any registration now would be voluntary so her choice. 
    No, she still owns it. All land is owned but not all land is registered. 
    Your solicitor is best placed to answer your Qs re legal responsibility if something happens as suggested. We don’t provide legal advice. We confirm who a legal owner of registered land is.
