Smart parking ASDA
Comments

Because she isn't disabled but needed the extra space provided by the not-in-any-way-legally-binding parent and child spaces. Any reasonable person observing would accept she had a genuine enough reason to be there, even if the child wasn't external yet.
I genuinely don't see the problem. I'd have let her use my P&C bay.
Moving on from that; assuming she shouldn't have been there, why should she have to pay Smart anything? Since she was observed, why didn't the attendant come over and direct her to an appropriate space?
Fully agree if someone saw her parking and knew it was no allowed then he should have informed her.I dont see the problem, but have also been in car parks where fully able people part the convertible in disabled and p&c spaces with a small dog inside and yet the carpark is almost empty0 -
In response to the email recieved from ASDA, i sent a reply stating how inconsiderate the reply was and that i would inform my freinds and family via social media never to shop with ASDA again. But this is what Iv come back to
"Good Morning xxxx,
I am sorry that you believe my email is inconsiderate. Please be assured that this was not my intention.
It is disappointing to hear that you will no longer be shopping with us however a clear breach of the terms and conditions has been apparent.
Kind Regards
ASDA"
I don't want to take up this issue with ASDA anymore as, they have made their intentions quite clear. It has been very frustrating finding out how they treat their customers. I had slight faith that they would step in and resolve the issue. But now, annoyed and disgusted by their replies. They clearly don't care !!I'm losing hope to be truthful. Family are hassling to pay up the £40, while it stays reduced at £40 for next few days as it will go up to £70.
I'm confused and frustrated .
-Sorry about the spelling mistakes and grammar.
As said in an earlier post, Asda seem to share the money the scammers generate so they have a financial interest ???
They have made it very clear to you and everybody reading here and social media that Asda is a store to avoid, they have no respect for customers
It is unbelievable that for the sake of cancelling a scammers ticket, they are prepared to expose themselves with such bad publicity.
They deserve to lose customers to the likes of Lidl and Aldi
Unreal stupidity0 -
The driver usually goes shopping with the kids and parks in Mother and child bay.But not on the day in question.I know she shouldn't have parked there but we all have our moments .
Why didn't the driver just return the items to the store for a refund?
Or use the cheaper shopping gaurantee .0 -

-Sorry about the spelling mistakes and grammar.Instead of asking why the driver parked there ? or why the shopping wasn't returned. I would really appreciate if someone suggests a way forward.Hindsight is a good thing but whatever happened cannot be changed.
coupon-mad has already told you (post #30 and #35) it should be appealed at day 25 or so, online , as keeper , by the keeper , so she has already told you the way forward, but in your plight you are BLIND to her advice (and to other regulars sage advice in a similar vein) - also fruitcake has told you the same in post #22 and also myself in post #38 (are we all wrong ?)
then if they fail to cancel its taken to popla, regardless of what the CEO is doing, not doing , has done
Smart have lost the contract, that is clear, so now its deal with the fallout and to take not so smart to popla and beat them on alll the other legal points
the fact the asda minions (or is that morons?) lower down the food chain havent got with the new program despite it changing in 2012 is only partially relevant and despite no landowner cancellation its always been the case that the keeper follows the BPA advice in post #1 and then post #3 of the NEWBIES sticky thread , regardless !!
CM was quite clear in her previous replies and in that NEWBIES sticky thread, only fools ignore her advice and we know that fools and their money are easily parted, dont we ?0 -

I know, I know, thats one of the problems of forums , the idea on replies is that the person replying should be trying to help the OP and to give advice etc, but many people just use it as an excuse to fire off at either the OP or at the people replying as happened to me yesterday
on forums that I help to manage, we tell posters to stay on topic and to refrain from posting UNLESS they are advising the OP or making a valid contribution and not just sniping or trolling because they have fffff all better to do0 -
Whenever there's a P&C parking issue we find plenty of randoms joining in to fire off. They're never on this forum at any other time. Do please ignore them, even though they can get under the skin at times.
So you should now focus your attention on defeating Smart at POPLA - not difficult, even without forum help, but with forum help you'd be very hard pushed to lose. Then when you have your successful POPLA appeal letter in your hand, scan or photocopy that to the Asda drone who's been writing to you, with a suitably crafted note to tell them exactly why they've got it wrong and there's no 'breach of the terms and conditions apparent' because POPLA have just confirmed that to you in writing.
And then tell them politely to stick the letter where the sun don't shine!
Revenge is a dish best served cold! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This is precisely what I would suggest.
Win at PoPLA then rub ASDA's nose in it with a well written grown up, "you were wrong and I was right so nah nah ne nah nah, and yah boo sucks to you:p:p."
