What a rude way to talk to customers, goes without fail that people should not shop with Asda due to the scammers they employ
Hope you will never shop at Asda again and tell all your friends to warn them that Asda employs money making scammers.
I would write a "private and confidential" email to the CEO again telling him that a member of his staff has "in a nutshell" told you never to shop with them again and that you will now happily abide and tell all the young mothers to avoid Asda in future.
Asda have no right to judge you on the "right's or wrong's" ... more so is it right to shop with them.
The other thought might be is that as Asda are losing money, they are taking a cut of each scam ticket issued ?
So a warning to everyone, BOYCOTT ASDA, they are not customer friendly ... SHOP ELSEWHERE0 -
Deapite being on the press for parking issues,It is shocking that they don't care about their customers whatsoever.Will NEVER shop in ASDA again !!
You are right, Asda don't care, why should we, they don't have the best products so go to Lidl or Aldi ...... And the CEO of Asda WONDERS why profits and sales are falling ???

Dear ASDA, I am in receipt of your recent communication ( which i have enclosed/attached for your convenience).
Unfortunately you now leave me with little choice other than to spend a considerable amount of my precious time in dealing with the British Parking Association Limited's ADR scheme, POPLA (Parking on private land appeals)
Should POPLA rule in my favour then i reserve the right to charge you for wasting my time as a result of the actions of your agents (Smart Parking ) at £19 per hour plus any other additional reasonable costs ( stationary, travel expenses etc)
Please also note that as a gesture of goodwill I am prepared to drop any charges for my time wasted on this matter so far, on the condition that you instruct your agents, Smart parking to cancel this charge.
I am also aware that ASDA have recently terminated their contract with Smart parking effective as of April 30th, however you (ASDA) will still remain liable for their actions started as up to the date of the termination.
I look forward to hearing from you within the next Five days so that this matter can be resolved.

Yes, they are only at the early stage of sending the template first appeal around day 22 after a windscreen PCN. So POPLA is certainly on if Asda keep saying 'computer says no'.
Vital NOT to imply who was the driver, seeing as Smart will probably forget to send a NTK in this situation, then they can win at POPLA on 'no keeper liability'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

IIRC (and correct me if I am wrong) Beavis hinged on the fact that terms and conditions were clearly displayed and agreed to by the driver.
The Asda apparatchik 'believes' that there is sufficient signage. They'll need to do better than believe.
They then say that the terms and conditions have been breached. So the driver is trespassing, there is no contract in force and no charge liable. What is their loss?
The same apparatchik says that that the driver 'potentially' prevented a parent parking in the space. So no loss can be demonstrated.
Surely this will never stand up to scrutiny outside the la-la land of not-so-smart parking.
For the record: I stopped shopping in Asda for a number of reasons, including when my local spawned signs which said that 'anyone seen leaving the car park on foot would receive a charge notice'. I saw the sign having entered the car park on foot. I could not leave without incurring a charge! Not so smart, I think.0 -

correct
never mind dangerous animals, they objected when the farmers were protesting at milk prices and took cows into the shops in protest and then were buying all the milk !!
but you are right, there is far too much of the "nothing to do with me GUV" attitude , usually from people who have not got a clue and yet seem to get in the highest of places, even councils and governments
as for the BB spaces alluded to earlier, they are usually in the planning permissions and/or covered by the EA2010 and my local asda has them outside the entrance , BUT my local asda no longer has the smart parking signs up seeing as they have lost the contract next month
so even if asda were to cancel, smart may try a CEL approach of still targetting those they have issued pcn,s to , regardless of the landowner cancellations (yes I know they may not win, but it still does not stop them trying)
so I suspect it may still be a good idea to get popla involved after a day 25 appeal to not so smart, if the appeal fails that is
and dont forget this saga in the telegraph this weekend (other papers were available , like the mail etc)

Asda have become masters of the fob-off letter Common sense does not exist in this company. Aldi & Lidl must be rubbing their hands with glee at the sudden influx of customers - not that they have anything to gloat about in terms of car park "management"0

I go to my local Morrissons now, no parking company at all, no Carmageddon either
its likely they had to provide free parking that allows for town centre access as most of the free council car park was swallowed up when they developed the site
so no rules about going "off site" yet no issues either, the car park is never full and the cafe bar and other facilities and shop are always busy too, but the staff do get mithered a lot about "are there any charges or rules I need to know about?"
