How to get my brother to move out

  • He has been to the council and they told him they can't help him - we all saw that coming but he had to try I guess?

    His finances aren't linked to ours in any way so there's no problem with our credit rating.

    It's now just getting him to use a new address for all of his financial responsibilities. We all know he should officially move in with his GF but she doesn't want to as she'll lose most of her benefits.

    He has already tried to use his debit card to withdraw cash today and he couldn't use it as it's out of date and no card has been sent to our address?!!

    misterzim - just keep repeating to him "oh that's a shame - what are you going to do about it?" Don't offer him suggestions/help - just keep asking him "what are YOU going to do about it?" Broken record syndrome!

    Btw - don't let him back in to decorate the room he used .....he'll start staying over - so that "he can carry on working later/make an early start"..........

    So, I felt the need to start up this thread again as I need some more advice from anyone willing to give some?

    My brother finally moved out on Jan 31st to move in with his girlfriend. Since then we have periodically received post addressed to him (as he hasn't changed his address on any of his bills as this would cause his girlfriend to lose all her benefits) which I opened for him with his permission, with one coming from Credit Resolution Services (CRS).

    It turns out he owed a final months gym membership at the gym he was using and didn't notify them to cancel when he cancelled the direct debit. The first letter stated this and he owed £20 to cover the fee. When I asked him about it he said he informed the gym. Another letter arrived with an increase to £70 for not paying on time. I told him again that he needs to sort it and he said he would. We've had a third letter in the last week which now says he owes £210. Again, he says he's contacted the gym and the CRS but no one is listening??

    The last letter also states that he has 2 options:

    1. Legal Action - through the courts
    2. Outsource to external agents.

    He assures me he is sorting this out but I know he isn't. What would happen if someone comes to our home to collect his debt? Is there anything I should be aware of when dealing with debt collectors/bailiffs under these circumstances?

    Any advice will be much appreciated.

    (I have already started to send post back to sender/not known at this address incase anyone was going to advise that!)

    if bailiffs turn up, give them hiss new address and say he no longer lives there.. I had to do the same when bailiffs turned up asking for the previous owner here and my previous house.. they are quite used to it.

    I forgot to mention, he has not (and will not) give anyone his girlfriends address, so there I can't inform anyone as to where he is currently living?

    so you say he moved out and is living with his gf whose name is *whatever* .. and they can check the address on the electoral register.. chances are she is on there if she is claiming housing benefit.. not guaranteed of course and let them get on with it.. they asked to see my tenancy agreement when it was a rented property and bank statements//mortgage agreement when I moved here.. as proof I wasn't the previous occupants.. bailiffs have no automatic right of entry so you can refuse to let them in anyway.. I kept them on the doorstep.. shut and locked the door while i retrieved the documents they wanted.

    For the credit files you may want to submit a notice of disassociation distancing the household from the brother financially so his credit file being tarnished doesn't have any impact on everyone else.

    Why would you want to assist them fraudulently claim benefits which they are not entitled to? It's not something I'd do for my brother. Just start returning all his post to sender and writing "not known at this address" on the envelopes. Everyone chasing him for money will eventually get the hint. Not that his credit file will have any impact on yours, it's joint accounts that financially link people not addresses but why keep sorting out his post and waiting for a debt collector to knock on your door.

    If I knew her address I would be straight on to the authorities now, I've had enough. All post will be going back to sender.


    Short of following him to her house I don't know what to do on that front?

    - but before then you'll receive court paperwork.
