Am I entitled to see their photos that were taken at the time?
To clarify, a landowner doing their own parking isn't entitled to request keepers details from the DVLA unless it's for tresspass?
I'm about to do a little more than complain to the DVLA. Thank you all for the advice given, it's really appreciated. I'll let you know what happens.0 -
as this is some sort of internal appeals panel and appeals process, we dont know what you are entitled to see or not see, which is one reason I would mention yet again for you to contact your union about this matter
as they are not members of an ATA , they dont have to conform , but as they are not members of an ATA , they are not allowed to get RK details for parking matters (in my opinion) , but are for trespass as landowners
they appear to have used local authority rules and laws to obtain these details, in my opinion that breaches the DPA and the dvla need a complaint filing because they didnt check this and decline the request due to the people requesting it doing so under rules applicable to a local authority, plus its private land so those other laws dont seem to apply
under POFA 2012 , they need to be in a trade association to apply for RK details for parking violations
I think they are living in the stone age and flouting the law and the rules0 -
For info that may help others who've found themselves having the same problem with this Trust, this was the original parking charge notice:

Earlier links in this thread don't work, my apologies.0 -
If I were you as well as complaining to the DVLA (not DVLC) I would:
(i) Make a formal written complaint to human resources about your employer harassing you and demanding money when they are in the wrong by failing to manage their car park properly, with the result that the space for which you have paid was not available. Study their grievance procedure first to ensure that you follow it.
(ii) If you are a member of a union, complain to them.
(iii) Complain to your MP
(iv) Start looking for a new job with an employer who does not regard their employees as a cash cow.Je suis Charlie.0 -
Hmmmm, interesting! Received this today with regard to my formal complaint to the DVLA:

Is it just me or is this odd? If this is correct, why do they give out 'parking charge notices' if they're entitled to give out 'penalty charge notices?'0 -
They are merely repeating the information that UHSM Wythenshaw Hospital put on the VQ616 form that the submitted to the DVLA requesting keeper details. This form is for Local Authorities issuing Penalty Charge Notices to manually request keeper details. It's the Council equivalent of the various V888 forms.
I don't believe that any body other than a Local Authority should be obtaining keeper details using a form VQ616 & I don't believe that UHSM Wythenshaw Hospital can actually issue Penalty Charge Notices. If the hospital have been obtaining keeper details fraudulently then this opens up a whole new can of worms.0 -
as Nigelbb points out ,form vq616 was designed as a back up for the automated system used by registered "councils" , if the online system failed https://www.whatdotheyknow.com/request/96696/response/244295/attach/7/FOIR2762%20Annex%20E.pdf
the hospital in question is NOT a council , and as such has obtained the info illegally ,
there has been a blatant failure of the data protection act , by allowing your information to be released to the HOSPITAL by submission of the vq616 form0 -
The DVLA are complicit in enabling this fraud?0

On the main route as you approach the hospital this is the signage that you would need to stop to read but you can't because of where it is (on a huge bend in the road that you can't possibly pull over on with yellow lines)
As you can see, it states 'penalty charge notice'

That's about a contract to park on access roads, not in a car park. The unfair contract law says something like, the interpretation most in favour of the consumer is what counts. I would interpret that sign as only appyling to access roads.
In your first post you said you parked within the car park, not on an access toad, so the hospital had no business asking the DVLA for keeper details, and the DVLA had no business giving it out.I married my cousin.
