  • How can they expect us to adhere to their car parking policy when they don't adhere to it themselves. They left the barrier up for all and sundry to abuse and their policy states:

    Under policy summary

The objectives of the Car Park Management Policy are:
􏰀 To provide suitable car parking facilities for patients, visitors and staff
􏰀 To provide and support the operation of robust traffic management systems to facilitate the free flow of traffic at the Trust’s facilities, thus supporting
good access to those facilities at all times
􏰀 To provide a safe environment for car park users, their vehicles and their
    property
􏰀 Ensure adequate controls are in place to ensure that the inappropriate use
of car parks is minimised and the availability of spaces are maximised

The NHS Trust is the landowner. The landowner can always purchase RK details from the DVLA. It's the same principle if some dumps a car in your garden r parks on your drive. ANPR, Proserve etc are all 3rd-parties who do not have an interest in the land they were operating on.

If Ransomes Europark as landowner apply to the DVLA for RK details they will be sold the data. The shady business using a fictitious payment to Proserve to justify the charge then having Proserve apply for RK details is what is not permitted.

As in this case the landowner is also the employer they will have far greater powers than any PPC could possibly dream of. They could make it a disciplinary offence & ultimately fire an employee for not abiding by the parking rules.
In this case as the car was displaying a parking permit & employees give their details when applying for those permits there wasn't even any need to purchase RK details from the DVLA. The employer doesn't need to use POFA either as the permit will be for that car when used by that driver. All details are known and in any case as I mentioned earlier as the employer this can shade off into disciplinary matters.

    Shade off into disciplinary matters?

Your employer is doing their own parking management they have not outsourced the operation to a PPC. When you are dealing with your employer you need to tread more carefully than if it were a 3rd-party parking company. At the end of the day your employer could fire you for breaking their parking rules so they hold far more over you than any PPC. It's the same situation for students at a college.
  • that is a valid point , however in this case it looks like the employer "might" not have stuck to the clearly defined route brought in , back in 2012 , *

and as such might themselves be acting illegally . if this was the case and they tried taking action (sacking/warnings) they could end up in very deep doo daa

*only companies that are a member of an approved ATA may gather info for PARKING ON PRIVATE LAND offences , and the ticket clearly states parking , not trespass
