NHS parking notice

I pay monthly for parking through my wages on a staff car park with a barrier that we have to swipe in to access. It's specifically for staff that pay for parking yet on many occasions the barrier is left up allowing all and sundry to abuse and park on the car park. This leaves less spaces for those of us that pay.

The barrier was up on one particular day I got there (it had been up for 3 consecutive days including this day) and there were no spaces so I did what many of us do....get there earlier than our shift starts and park safely without blocking anyone to wait for a space. I parked on yellow lines within the car park temporarily and sat eating my dinner while waiting.

I was given a ticket whilst sat in my car even after explaining I was waiting for a space to become available and was harassed for about 15 mins of sitting there whilst the guy that gave me the ticket passed comments every so often so I told him to go away and stop talking to me. Another member of staff passed and joined in so I had proof that I was in the car whilst he put the ticket on my windscreen.

I didn't pay, I emailed the appeals dept within the time allowed and explained why I wasn't happy to pay whilst pointing out part of their own car parking policy and how they couldn't adhere to it by leaving the barrier up and sent them proof of my shift start time for the day showing I had over an hour to wait for a space to become available along with the attitude of the guy issuing tickets and that I was sat in the car while he did it.

I never heard a thing from my appeal but have now received a letter telling me they received my details from the DVLC and that they hadn't had payment and would be passing it on to go to the county courts.

Would you pay?

    Who are the parking company?
    With your appeal did they give you a chance to appeal to an independent body (POPLA or IAS?)

    I wouldn't pay, but the strategy will depend on your answers.

  • Unfortunately the DVLA/C only care about money and these parking companies apparently have the right to ask for such details for a payment.
    It doesn't mean in any way, shape or form they are approved by the DVLA/C or they have any legal case against you.

    Write back to the appeals people and ask for a popla code to take the matter further should they reject your appeal.
    Might also be worth checking out the pepipoo website.

    The parking company are the hospital themselves via estates and facilities. The Appeal Dept is estates and facilities. I asked the Chief Exec himself why I had been given a ticket whilst the barrier was up and he stated that yes the barrier was up for repairs and renewal but nothing in regards as to the ticket.

    I'm not bothered about them getting my address from the DVLC as such, more that I had no response to my appeal.

    The postman delivered the letter from them today via recorded delivery which I didn't sign for as I was out all day.

    I query this , as for getting your info via a method recognised by the DVLA for parking

    Does the fake ticket display either a BPA or IPC logo ?

    Having looked at their web page they don't appear to have either logo - I'd just ignore them. They can't get your details from DVLA and if they know your reg as a worker just say "prove it was me driving" as they can't have keeper liability.

    me thinks an email to the DVLA is in order , ONLY members of the IPC and the BPA can get data for car parking charges , and this can ONLY be handed to IPC/BPA members


    is there any chance of scanning/photoing the ticket , or the letter received today
