I'm on the phone to cpw and the lady said I can not cancel because o2 have stated in their TC's that they can change theit TC's without prior notice........

Your contract is with CPW and you can cancel under their terms and conditions. Their agent is misinformed and has misinformed you. See here, especially term 11.5.3:

The lady has pointed me out to this point:

15.1 We may change this Agreement and the Charges at any time. If we increase our Charges for the elements of the Service you are using or change the terms and conditions of this Agreement to your
significant disadvantage (in our reasonable opinion), we will give you 30 days' notice in writing before the change takes place. We will notify you as detailed in clause clause 19.7 below or we may

    from this o2 contract: http://www.carphonewarehouse.com/commerce/servlet/gben-server-PageServer?ARTICLE=MAIN.UK.INTERNET.HELPINFO.ORDERONLINE.NETWORKTERMS.O2

Yes, as well she might. Call her back and quote term 11.5.3 to her and tell her on that basis you wish to cancel.

Are you sure you can cancel the contract without to pay an opt out fees?

Just rang them, they quoted me that to get out I need to pay. So the supervisor given me, (to complain) the Head office number: 01132722000

    Address:

    Cheryl Black
    O2 UK
    260 Bath Road
    Slough SL1 4DX

    .

The telephone number is for Leeds ( complaints) not Slough

PS I think we should all blitz 0870 numbers prior to 28/09 with any unused minutes left on our ending contract, so they have to pay BT what owns the dreaded NG numbers.

( AND dont forget that it was BT that set the prices for NGNs based on their original national and local call rates at the time.

Thanks to NTL for getting geo calls reduced to 3/2/1p/min or we would still be paying those rates to ALL numbers )

They say I did not ring any 0845/0844 numbers in the past so I can't just ring and use the increase in charges for 0845/0844 as an escape goat.

    Surely I can still cancel?

I upgraded with cpw o2 £35 on Aug 14 2007. I was told I could use 0845 and 087, hence I took the deal, I have had no text or letter. So suppose can't do any thing till I get a text or letter.

Yes rack up a lot of free 084"/0870 numbers in the next week or so, then your account will show that you do use them, excuse gone.

You still have 30 days in which to cancel. try and try again til you get the reply you want. Each CS employee will not be up to date or possibly in the same call centre, such is the state of CS today. :rolleyes2

Well I rang CPW o2 again at 5.30pm today, asking to have my contract cancelled, told her about point 11.5.3 of the o2 TC's, she went away for 2-3 minutes, and came back asking to ring on Monday as they are unable to deal with it at the moment.

I did ask to be put through to the retentions dpt, but she said there's no real point as I would be waiting over 45mins, what with the lines closing at 6pm.

I did ask, however, if I was able to cancel my account, and she said yes, definitely, and put a note on my account so I don't go through the agro again on Monday.

Hopefully I get a result on Monday.
