Hello,
I sent off my first cashback form and OSPS sent me a letter saying that my bill was older than 28 days and therefore all my cashbacks were void. This isn't true as my bill was dated the 18th Feb, i have a royal mail recorded delivery slip dated the 6th March (if it was delivered the next day it would have been 18 days old) and they sent me the letter on the 14th March when the Bill would have been 26 days old. I've emailed them 3 times and tried to phone them but i am just kept on hold or cut off so i haven't been able to speak to anyone.
What should i do? I've sent the right bill of at the right time and I sent it to the address stated on the forms. Should i write a letter to them with all the details, i just don't really know where i stand with regards to how to complain as there are no details on the website. Any advice would be really apreciated!

As long as you are sure you have stuck to the terms, write a LBA, tell them you have adhered to the ts + cs, and they haven't.
Tell them you now consider their action of not paying you a fundamental bereach of your contract, and ask them to now pay you all money outstanding from the original and now breached contract within 7 days.
If this fails then sue.
This advice is regularly posted by many across this forum to answer queries of this type.

To whom it may concern.
Letter before action
You have recently refused my first cashback for the mobile phone 079xxxxx, stating "the bill was more than 28 days old (using their wording)".
This is incorrect. My bill was dated x and i have a recorder delivery slip proving i send it on x.
I have tried to contact you by email and phone without response.
I have adhered to the terms and conditions that i agreed to at point of sale.
You have breached the terms and conditions by refusing my claim.
I now expect you to pay £x for the refused claim and £x for all future cashbacks. I expect this to happen within 7 days of receipt of this letter.
If this does not happen within the timescale stated, i will be forced to take this matter to the small claims court.
ANYONE?
what do people think? any suggestions on the wording?
what do you think they will do?
what happens if they agree to pay the first cashback, does that un-breach them?
could kflex still push for the whole amount or just take the first cashback and return to the cashback schedule?
kflex, double check all your dates are correct first, not just the 28 day thing, but every thing else as well.
in fact post your connection date and date you sent your first bill so someone here can double check it first.

Sorry to ask this as i may be be able to dig out this info on this thread after 4/5 hours study but has anybody been successful using a 'fundamental breach' MCOL summons against OSPS. Many thanks.0
