Hi all congrats to the sucessful re-claimers!!!

2nd reject letter off Egg today summary:-

-I chose to take this protecetion of my own violation during my online application .

    - I was presented with 'yes/no' option to which you (me) selected yes....blah blah

    - They have only been fined for phone applications fromJan 2005 onwards and is not applicable in your case at this time.

    Last line I found interesting!!

So off to the FOS I go. Fingers crossed

Still waiting to hear from nationwide.

    Hi folks,

    Quick update regards Morgan Stanley/Barclaycard......

Received a letter from Barclaycard stating that they did not have any record of my account number as their takeover may have been after I cleared my balance. However, I checked with my Equifax Credit Report (very handy when it comes to obtaining start/end dates for agreements btw) and the account was satisfied in 2008 - after the takeover.

Anyway, phoned Barclaycard querying this info and the Customer Services advisor could not have been more helpful. She advised me to look out an old MS statement which showed PPI been taken off the account and fax it to them along with a breakdown of any refund being claimed over the 8 years I had the card - result!

I had thought that they might offer me under a grand but when I did the calculation in came out to nearer £2,200!!!!!

So I now wait with baited breath for their response - fingers crossed...

    Cheers,

    Dunkydo

Hi have they made you an offer of £2200 or is that what you worked it out at Thanks Sunny

Rightio...well you can either ring the FOS to send you the form through the post or download and print the complaints form from the FOS website, remember as well to enclose copies of the final letter and anything you have to support your complaint, good luck.;)

I won, I won, I won..... BUT not the interest element of the PPI in my rebate complaint but still a nice amount that will help with Christmas nicely...:D

FOS have not had to adjudicate as i have been in contact with Lloyds of London who have agreed I was unfairly rebated on the PPI and they have paid back for the unsued months and the 8% statutory interest and cause they offered me a totally wrong amount (which would have been nice!!!) and then withdrew it also by the end of the day I was given £250 for stress. I did not even have to ask for that one.;)

Just spoke to FOS this morning (the manager who deal with all complaints like mine against underwriters) and he said that all complaints where you have been unfairly rebated are within jurisdiction (if you can prove your rebate was unfair) BUT they only rebate your actual PPI and not the associated interest. I also asked about misselling complaints against insurers/underwriters and he said that as yet they had not had any cases whereby the underwriter had actually taken responsibility for them but they are still trying. I am just glad that all my reclaiming is finally done and dusted.

Thanks for anyone that egged me on... I would never give up and perseverance has paid off in the end.:beer::beer::beer:

Just rang them to accept their offer and could not resist to ask for a nice Christmas hamper and also a bottle of bubbly..... he just laughed....lol I wonder....................now I am dreaming....

:j:j:jReally pleased for you marshalka - I personally have found your help & advice invaluable so glad to hear you have had this win
