I applied for an egg credit card online in 2002. About 18 months ago I cancelled the PPI on the account as I am covered by my employer.

Having investigated the mis-selling on this site and others I came to the conclusion that I had been mis-sold.

Sent a letter to egg last week stating that the on line application used tick boxes for PPI and that it wasn't clear if I was buying it or not. The documentation that they sent me at the time included details of the PPI but did not mention the fact that this was an optional insurance.

I have logged on to my egg account today and to my surprise the account has been credited by just under £5k.

I am amased at the speed of response and staggered at the amount refunded! I am also very surprised that egg did not try to contest my claim in any way.

I hope this will encourage others to continue with their claims.

Congratulations! This filled me with confidence and did exactly the same for my egg card. Applied Feb 2001 on line and cited the same reasoning plus the fact that egg have been fined by the FSA.

I have just received a letter this morning saying they are unable to uphold my complaint referring to their online proceedure:
    • Does not require you to take PPI as a condition of obtaining the credit card
    • Does not provide an advisory service
    • Required you to positively confirm that you wished to purchase this policy during the online application
    • Provided full terms and conditions of the policy and requested you read them before submitting.
It goes on to say we are unable to uphold your complaint and can confirm it has been closed. Should you be able to provide any further evidence we are happy to review the decision.

They have provided me with a print out of my application as evidence (which in all honesty is slightly meaningless to me)

Are egg just randomly choosing their responses?! Can anyone advise me on the next step (especially as they haven't referred to the fact they have been fined).

Do I have a leg to stand on with this now they have provided me with contrary evidence?

    Cheers everyone,
    Matt

  • Hi - I've looked at the paperwork but am unsure who the insurers are. How do I find out this information? Thanks in advance

    Well done and Congratulation.:beer::T:beer:

I would still try to reclaim on the ones not regulated, many of us are in the same situation and have taken it the underwriter/insurer side of it, as most these were regulated, the FOS have accepted looking at my case and other on here by going this direction, so find out who the insurers are and write to them, give them the usual 8 weeks, if they don't resolve for you, then you can ask the FOS to investigate this for you, good luck, keep at them.;)

If you no policy details, contact them to ask them to send you them, they should be enclosed on them.
You write to the lender for these.;)

    Hi Matt
I think its time you moved this on to the FOS now, you can contact them to send you a form through the post, or download and print one from their website, enclose copies of all correspondence and anything you have to support your case, do not give up, good luck.;)

Thanks for the advice. I'm going to send off a second letter to Egg reiterating the points. If it's still a rejetion then onto the FOS I go. I'm not going to give up on it at the first hurdle!

Barclaycard letter sent today so we'll wait and see on that one!

If you haven't already done so I would suggest that you check the credit agreement - one reason I used was the fact that they had included the details of the PPI on the agreement including the cost. They did not however mention anywhere that the PPI was optional.
Hope this helps - don't give up!
