  • Help!!!

    I have just recieved a letter from capital one stating that i ticked the box for PPI, they have sent a copy of the paperwork with my signature. The response letter i received stated:

    thankyou for writing to us regarding PPI......... that we have added to your account.

    Your comments are correct regarding Capital one being fined by the FSA regarding the sale of PPI. As part of our resolution to the issues identified by the FSA, we wrote to all the affected customers and offered them a redress that enabled them the either retain thier policies or cancel them at no cost to them selves. Id like to assure you that your account was not one of the ones affected so we have not contacted you about this.

    We sold the PPI to you when you requested it when you applied on the internet for an account with us. We then sent you documentation to tell you the PPI was optional. You ticked and signed this to agree to taking out the PPI. I have enclosed a copy for your records (has a tick box and my sig saying i want PPI, yet nothing whatsoever about the policy itself)

    Cap one is authorised an regulated by the FSA...... baldi-bladi-blah blah blah, we are therefore required to ensure that our marketing material is clear, fair and not misleading. PPI is optional and this is made clear to you within our marketing material. Capital one is not authorised to provide advice in relation to insurance products (<<<< so why the hell are they selling it? is that legal?), Capital one would therefore not have made a recommendation that you should take out the PPI, or advised you that the product was suitable.. You recieved a full policy document which included full t&Cs and policy summary prior to the conclusion of the contract. This contains a full list of exclusions and outlines the cost of this policy.


    I took this out 5 Sep 05, between the window. If im honest the paperwork is rubbish. When i signed the paperwork it does ask if i wanted ppi and i ticked it (Thinking that i needed it to get the card)

    This is the response recieved following the first letter.

    Is it worth me continuing with a 2nd letter?


    Any help is greatly appreciated

    Basically, what they are saying is it was a non advised sale of PPI but as this was since regulations began in Jan 2005 there was still guidance in force at the time they should have followed. Its a bit of a get out clause saying non advised but you can still go to FOS if they do not uphold when you write back as I take it this is not their final response. If it is their final then take the complaint to FOS.

    Take a look at this leaflet and before you write again see if you can pick out anything that applies.
