Just had a letter back from Lloyds saying they have passed the matter on to General Insurance, however we never had any dealings with this company so surely they can not be responsible for the mis-selling. Are they just passing the buck/stalling? Should I respond now or wait for General Insurance to respond.
(The Policies were taken out 6-8 yrs ago and my OH was unemployed.)
  • I was reclaiming against a a loan i took out with natwest and was quite sceptical that i would recieve any offer of a reimbursement, as it happens i have just recieved £1728.26p! i was self employed at the time of taking out the loan and although the insurance policy is not completely useless the fact that i was advised by the staff member at natwest that i would not get the loan without the insurance has had an effect on their decision!

Have not recieved a letter explaining the reasons for the rembursment but will post again with further info! Would suggest to anyone considering sending thier template letter that they do so as soon as possible because it works and the feeling of beating the bank is worth more than the money in my account!
  • Just had letter back from Egg saying that I applied online and was therfore not mis-sold.

Has anyone had any experience of this and does anybody have any information as to whether the boxes contained on the application form were pre checked/ticked?

All help massively appreciated. I cannot find anyy reference to a similar situation after searching this forum.

    Cheers

My claim was also passed to General Insuarance who have dealt with it rather quickly. They are the insurance arm of Lloyds TSB. Just one letter and they offered my refund without accepting the policy was mis-sold. As loans still active they insist on it be offset against them. This means one loan will be paid off so I won't grumble but the cash would have been nice!

Martin’s article into reclaiming says this…..

“How far back can you go?
Decide from this list which is most relevant to your situation:
    • If your policy started in the last six years, whether you’re still using it or not: Reclaim and ask your lender for a copy of the paperwork if you no longer have it.
    • If your policy started over six years ago and you are either still using it, or it ended within the last six years: Reclaim and ask your lender for a copy of the paperwork if you no longer have it. Your chances of success may be reduced if you have been aware of the mis-selling for some time, you have already complained or your account is very old.
    • If your policy ended over six years ago and you have the paperwork: Reclaim, although your chances of success are reduced, as it will depend on what you can remember about the sale.
    • If your policy ended over six years ago and you do not have the paperwork: Do not start a reclaim. As lenders only have to keep records for six years, if no one has a record of the contract a reclaim is unlikely to be successful.”

I have now had 2 letters from Barclays (for a Woolowich ppi) saying that as the policy started more than 6 years ago I am ineligible - this doesn’t seem to fit in with the above. Does anyone know what the situation really is?

(My policy started May 1997, ended August 2003)

    thanks

paula7924, I was given the following advice:

    Dear dawnbabe,

I hope that this may help you,

    The Limitation Act 1980 states:
    (c) the action is for relief from the consequences of a mistake;
the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it.
References in this subsection to the defendant include references to the defendant's agent and to any person through whom the defendant claims and his agent.

This states that you have from the time that you found out whether or not it was outside a six year limit.
    Good luck

I got the same letter but wrote template letter 2 back to them with this inserted:
You state you cannot consider the complaint: “more than 6 years after the event or (if later) more than three years from the date on which he became aware (or ought reasonably to have become aware) that he had cause for complaint.” We only became aware we had cause for complaint and were able to seek retribution following a television broadcast by a financial expert in January 2008; additionally this falls within the time frame specified above ie 6th April 1999 + 6 years = 6th April 2005 + 3 year time frame from the date we became aware of this = 6th April 2008.

Got a letter thefollowing week offering £482.19!!! Don't give up.

I've just yesterday received letter saying that they are going to refund my premium paid!

    My original post was #500

    What were you reclaiming: Loan
Who was the provider: Lloyds TSB
How much did you get back: £838.35 plus interest
Did you get it back after a letter or did you go to the Financial Ombudsman: Wrote 3 letters, template 1 & template 2 twice

Wrote 1st letter of complaint in November 07, had a couple of replies saying they were looking into my complaint, but needed more time. Eventually replied saying No, not entitled. Sent 2nd letter, replied saying No, not within 6 year period. Sent 2nd letter plus info from above post and have received letter offering me full refund of the premium!

Am so looking forward to money landing in my current account!

Huge thanks to this site & kpwll & jrobinson4 for the advice you gave me!

  • this is my first ever post although i have been hovering around for quite a while now!

i have just received a letter from first plus telling me that they are going to repay me £6975 PLUS interest for a PPI that i was bullied into taking on a loan which we had with them in 2004. i repaid the loan early after only a few months and was told quite callously that i would NOT be getting any of the PPI back and that was that. obviously at the time i felt completely sick but resigned myself to the fact that i had lost a huge chunk of money. the sales person did the usual trick of telling me i wouldnt get the loan if i didnt take the ppi etc. etc. so i just took it. anyway, along came martin and this brilliant site which i must say has inspired me to look back through all my bank statements, paperwork etc. in a bid to find anything that looks like an unfair sale or underhand selling by any of the big money institutions that i have ever dealt with. talk about woman on a mission! i took a deep breath, made a few phone calls, wrote a few letters (or rather filled in the template letters, how easy was that?!) and bingo. to date i have clawed back £1728 bank charges, and the £6975+ for the ppi. i have also been hot on the heels of a couple of other ppi's and am currently waiting to hear from them, two mortgage exit fees and im suing the holiday company that sent us to a closed hotel last year and charged us £4000 for the privilege!!

so for all you people out there, dont give up hope. it may take you a few phone calls, some time on the computer and a few headaches but IT IS WORTH A TRY. it only took one letter to first plus and a phone call to the FOS.

    im a happy bunny!:T :T :T

I have just had a victory against Welcome Finance regarding PPI - if anyone wishes details pls PM me and i'll let you know the details...
I have just read your message, could you please tell me how you got your result from welcome. The next stage for me is to take them to court because I believe I have a good case. Any advice would be useful.

    thanks
