Won against firstplus recently. Full ppi + interest but the interesting thing was they first refused the complaint as the loan had finished over 6 years ago, saying time had expired.

step in the FOS and a 5 weeks later we get a result.

thankyou to this excellent site !!

Thats brilliant, seems a lot of firms are actually looking into complaints now as regards just dismissing them after the new proposals by the FSA. Seems to have shaken them all up.

    Well done. I love a FP winner:beer:

    Hi and welcome.

For more info on mis selling check this link here to give you more of an idea:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

For the reasons you have, you can write to them and ask them to refund your PPI and interest you have paid.
They have 8 weeks to respond in full, keep at them until they resolve in your favour, or until they issue you with the final response, if eligible they will also enclose the details of the financial ombudsman service (FOS), where you can take your complaint to these if your not happy with the outcome.

You do not need to write down the amounts though.
You will find a checklist of mis selling reasons on the above link, also templates, if you can though just use the templates as a guide, and write the reasons that occur to you.

Best to post by recorded delivery, this is your proof of posting.
Good luck and please keep us posted.;)

  • Hubby had a Morgan Stanley card (then became Goldfish then taken over by Barclaycard) which he 'applied' for in 2002 at a motorway service station (hadn't intended to but got drawn in by a glamorous young lady touting from a trestle table!!). Anyway, I helped him claim for mis-selling.....

He sent the first letter on 9th may - after initial 'we will look into your complaint' reply, got the response that hubby had provided an invalid account number and they had no record of an account held in his name (stalling tactics??) so they considered the matter closed (huh??). We had provided the correct a/c number taken from statements although the account had been transferred to Cabot in 2008, but they should still have held records.

8th July Sent second letter with copies of statements clearly showing account number and PPI payments and re-iterating why he thought he had been mis-sold.

Received letter 22nd July asking him to fill in questionnaire to assist their investigations. Hubby replied 27th July that he felt he had given sufficient information therefore was returning their questionnaire unanswered and again re-iterated why he was mis-sold.

Heard nothing since so sent a final letter 5th October saying as there had been no response from them since July that he was giving them 14 days and he would pass to FOS. Today received letter (dated 5th October......hmmm coincidence??) stating that they feel 'there is a lack of supporting evidence to confirm that the sale of PPI was carried out in accordance with our standard procedures' and offering refund of £496.74 plus interest - total just over £900.00!

We aren't sure how they will settle as the account is now with Cabot, but either way a good result!

If you have been mis-sold, don't give up....we almost did at the first hurdle!
