Hi all,
Haven't been on for a while as I've been waiting for the outcome of my claim against Loans.co.uk which went to the FOS and has taken over 18 months to be dealt with!! I finally got their decision - they upheld my claim - and Loans.co.uk are now supposed to be paying out. However, Loans.co.uk have now exceeded the 8 week time limit given by the FOS to contact me with details of my payout. I contacted the FOS last Wednesday who emailed Loans.co.uk. Up to today still no response!!! I am quietly seething...............

Thanks pinkniko and Di!! I could still be waiting if I hadn't hassled the FOS! When I rang I was told my case was with the adjudicator!! I explained that it had already been passed to the ombudsman some months previously and when they checked and agreed that yes, it was with the ombudsman, they chased it up and I heard within a week or so. This last leg of the wait is frustrating. especially when the companies concerned are given a time limit of 8 weeks and don't adhere to it!! Ah, well, the end is in sight!!!
The family are well thanks Di. The baby (Hannah) is now 8 months old, doing really well after all the stress at the beginning of her life, and is a lovely, happy little girl. Growing so fast though!! Not sure if the 3 grandkids are keeping me young or finishing me off! Bless em.0 -

Your case has been a very long one with the FOS.....18 months and so, a very long time, glad you have some answers at last.

Final Update - hopefully! All monies now paid to me by EGG after 2 years! FOS etc etc and then EGG took all the cash back!!! AHHHHH! BUT now Hooray! Over £2000 with an apology from EGG for "everything"! Worth all the hassle now I look at my bouyant bank balance! Thanks to all on here for the kind words and encouragement! The forums really do help lift my spirits!0

If the latter is the case then i would say they are within their rights to take the money against the outstanding balance you owe them (if it was written off??) but if you actually settled it early and repaid to them this £8803.14 (from redundancy money perhaps) then I would say that you should be entitled to reclaim it back.
From your post it seems that you left an outstanding balance unpaid on the account and then they have stated that they are not paying the redress money over to you???. Is this correct cause if this is right then surely by reducing what you owe them is better than having a large amount outstanding. As this was only 2006 and if not actually "written off" then they would be entitled to collect this for 6 years I think from the date it was outstanding plus interest and fees perhaps.
I too am confused by this?? Can you please clarify?
Thanks for your reply - I'm sorry i I did not explain fully. When I was made redundant I called to claim on my PPI and they said I couldn't as it was not covered for redundancy???. So I went to a debt solution company and they made up a financial statement and agreed for me to pay back the loan at a reduced repayment. I did this for about 18 months when I left my job due to being sexually harrassed and I stopped paying completely. HBOS never ever contacted me again.
Recently I got a copy of my credit report and this loan was showing as "SETTLED". I assume they wrote it off as a bad debt or something. I couldn't really afford they repayments anyway as the PPI was so high. My experian report shows the loan as being "SETTLED" in August 2003. I originally took the loan out in 2000 over 5 years.
I hope this helps you be less confused rather than more confused.0
