    How much of the loan was owing when they wrote if off and how much was the PPI in total? Also how many "proper" repayments did you make on the loan before defaulting. All this would be relevant I would think. If you know this then you could argue that you could have afforded the repayments in full without the PPI being added and carried on with the loan repayments and not had to take a debt solution plan etc. I think this is a hard one really.

    I assume you made 18 months reduced payments and it was originally over 5 years but it was settled in 2003 so that was maximum 3 years later. You actually most probably made a maximum 18 months repayments with the PPI so how much of the repayments over that 18 months were PPI? Did the 18 months PPI make it where you could not afford the rest of the loan and when you made the other 18 months in reduced payments were the reduced payments lower than the "original" repayments without the PPI added. It would help if you knew all of this. If your PPI was more than you actually had written off then I would think they would pay the difference.

    Maybe someone who is in the same boat could post up or maybe if you ask on the loans board or debt board they would be able to help. I would think that even if you won on this they would be entitled to use the money against the debt. Others may view different.

    Who was the provider: HSBC
    How much did you get back: Don't know yet
    Did you get it back after a letter or did you go to the Financial Ombudsman: Had to go to FOS

    I started this claim way back in September last year.
    I sent HSBC my first letter and got two holding letters then bang on the eight week deadline I got a letter saying they would not be up holding my complaint, that was the end of October 2008.
    I did'nt go to FOS at first, I just thought I had lost that one. But after reading reports from others on here I went to the FOS with my complaint as I thought I had nothing to lose. Anyway a few letters back and forth and the FOS has informed me that HSBC are willing to repay my PPI payments as a good will gesture, I will need to wait up to eight weeks to get the amount to be refunded confirmed.
    If in doubt go for it.

    hi and thnks Chris. we have a claim in with Lloyds, and although today's artile on MSE states that Lloyds have the biggest upheld claims with the Ombudsman re mis seling PPi we don;t see many on the forum. This has given us some hope. Thanks again.

    How long should the bank hold records of settled a loan account for? I took out a loan in 2003 which I settled in November 2005 but the bank claims to have no record of this loan? Anyone? Gill

    Gill, I am aware its 6 years, England/Wales and Scotland 5 years, however some are lucky to even receive data going back from earlier years.;)

  • Thanks di, so what do I do now as I do not have the agreement. They are saying that it has not been kept as too much time has passed since it was settled, but that would only be 4 years ago? Gill
  • 2nd success for me this week!!
    Provider - A&L
    PPI on a loan back in 2004
    Repaid - Monthly premuims - £306, Rebate adjustment - £853.61, Total refund - £1160.40, AND they have added interest - £513.14 on the total refund up until 30 Sept 2009 - so GRAND TOTAL of £1673.54.

    So far claimed back from MBNA, Egg and A&L for the PPI. All done under 1 letter to each of the providers.
