well i just got a letter back from MBNA saying that I bought the policy over the phone. I certainly did not do this! I applied online in 2001 and only spoke to them to activate the card. They said unfortunatley they dont record all calls but they are confident their sales process is compliant. They also said I've left it too late to take it further as its outside of the time limits for referral to the FOS.

Then they implied I was a bit stupid saying I see it on my statement every month so I had plenty of time to cancel!

    Is this worth pursuing?

    Thanks :)

    Hi there

    I would most certainly try.

Do you still have the agreement for this?

The FOS are only able to investigate complaints if the company in question were covered as such on the time you taken out the finance, but there maybe other ways of help around this.
Melorablack for instance may have more advice for you on this one, hopefully she will post here at some point later on.;)

If that was not the final response, then write back to the company, tell them you want this reconsidered and are aware this was "not" sold online.
(maybe you have never purchased finance online before, - tell them that), and also tell them even if the FOS are unable to look at this then you will still seek advice on this matter.
    Good luck.;)

I was told by my caseworker last week that I should be told the amount by letter at the back end of last week, I didn't get the letter so I rang up about 20 minutes ago to see what the dealio was.. she said she sent it out last Friday second post, so I should get it Wednesday, I asked if she could tell me amount over the phone and she ummed and arrr'd but said, yeah I don't see why not.. anyway, NatWest are giving me back £595.55! :T

I know I maybe able to push for more through the FO but to be honest I'm chuffed to pieces with the amount.

To think that I was going to give 25% of the 'winnings' to a company when all it took was Martin's letter, you're guys advice and a bit of clever wording from my manager (who I have to buy a McDonalds Big Mac meal because of this :rotfl:).

A big thanks to those who told me to pursue this myself :money:

Awaiting PPI - Lloyds TSB Loan
    Debt Free Date: [STRIKE]30/10/09 02/10/09 07/08/09 [/STRIKE] 10/07/09
  • Hiya all

I have had several loans from HFC and they insisted I took out PPI. They didn't even put the amount on the forms (just said it was 13% i think).

Anyway a couple of years ago I complained and cancelled the PPI. They wouldn't admit to mis-selling so I left it. I then paid of the loan in full. Last year I complained again and asked for a final response and they still said they didn't miss-sell. I had asked them to look at the last two loans I had with them. I did get in contact with one of the Solicitors on a no-win on fee and they had a look at my case. They then said that they were going to take it too the FOS because it was still within the 6months. I decided to send it to the FOS myself as I would have had to pay them myself. I wrote to the FOS in April. They wrote back saying that although HFC had sent a final response for the second loan, they had not looked into the first loan. FOS said that HFC must look into the first loan PPI before they could look into it. FOS letter was dated 13/5/09. HFC wrote to me on 15/5/09 saying that they could not find any supporting evidence regarding the PPI and offered me £680 which is full repayment of the PPI plus 8% interest.

The solicitor raised a point about HFC that when you pay of an existing loan they did not recalculate the outstanding loan amount properly because they include the interest from the PPI. Does anyone know if this is true and if so should I ask them to include this before accepting?

    Regards
